SC 5100 EIS Data Collection • Any use of EIS funds will require the submittal of the SC 5100 EIS Data Collection form – even if only using for professional development • An LEA must count and subsequently track for two years the number of students in need of additional support who received instruction from personnel who participated in the professional development program. • Count the students who benefited from the personnel who participated in the professional development in the year or the year immediately after the training. BS 6006 Part 7 Other Costs • Student Employment • The cost of employment of students with disabilities by the LEA is allowable with IDEA-B funds ONLY if the employment is related to or in addition to the student’s course of study as part of the student’s transition plan. BS 6006 Part 7 Other Costs • Student Employment • Factors that would indicate the LEA benefited from the services include, but are not limited to the following, continued: • Participants are performing services that, although not ordinarily performed by employees, are clearly of benefit to the LEA. • Placements of participants are made to accommodate the labor needs of the LEA rather than according to the requirements of the student’s IEP. BS 6006 Part 7 Other Costs • Student Employment • The Fair Labor Standards Act (FLSA) defines the word “employ” as “suffer or permit to work.” • Detailed guidelines have been developed by the Federal government to help employers determine employment vs educational relationships, child labor requirements of the FLSA, as well as Internal Revenue reporting requirements. • It is the responsibility of the LEA to consult and follow Federal and State laws and regulations.
