New rules for FFCC under age 26 • As of 1/1/2014 Former Foster Care Children who have aged out of Foster Care (at age 18-21) are eligible to Medi-Cal under aid code 4M until the end of the month in which they turn 26. • Prior to 1/1/2014 they were only eligible until they turned 21.
These applicants are only eligible to retro AC 4M coverage back to 1/1/2014 since that is when the Affordable Care Act took effect. • If a FFCC is currently age 24 and has not had AC 4M since they were 21 they could apply now and receive retro for January 2014 only. They would not be eligible to retro for December or November 2013 as that is prior to the ACA effective date. • If they apply in April they could request retro for Jan, Feb & March 2014.
CalHEERS is not currently programmed to disregard FFCC’s income, thus any applications for this group will be forwarded to the counties to process. • C-IV has not yet been programmed with functionality for this new age group, thus workers will be required to perform a manual override to issue AC 4M to these beneficiaries. • The FFCC coverage group does not go through a MAGI determination. All income is disregarded for this group. • Eligibility is based on their being in foster care on their 18th birthday, currently between the ages of 18 and 26 and currently a California resident.
How do FFCC apply for Medi-Cal • Beneficiaries currently in foster care when they turn 18 or older (if aging out of a foster care program that expires at age 19-21) the EW should roll them into AC 4M from their current aid code without a new application. • Individuals who were in FC on their 18th birthday, but are not currently enrolled in foster care or Medi-Cal may apply for Medi-Cal using the form MC250A. This form refers to individuals age 18-21, but with ACA expansion it can be used up to age 26 until the forms is updated or replaced.
If the FFCC applies in the County of origin or the county they were in when aging out of Foster Care, verification of having been FFCC should be readily available. • If the FFCC applies in a county that is not the county of origin, the county should initially determine the individual eligible and put them into AC 4M based on self-attestation of FFCC status with 30 days reasonable opportunity period for verifying FFCC status. During this time the county shall verify the FFCC status at age 18 by either: • Accessing the DSS CWS/CMS database or • Contacting the county of origin.
FFCC applicants who were in foster care out of state can provide documentation from a public agency that verifies the FFC on or after their 18th birthday. If the applicant does not have verification the county shall contact the state the applicant was in foster care to obtain the information needed to verify the applicant is a FFCC. • If neither the applicant nor the county can obtain the information needed to verify FFCC status and the applicant’s reasonable opportunity period has ended the county shall ask for needed income information to determine eligibility for MAGI based coverage until FFCC verification is received.
