  4. Thailand has no special legislation for the implementation of the TBT Agreement

  5. To ensure the fulfillment of the notification obligations - Arrangements and co-ordination with relevant regulatory bodies have been put in place through the mechanism of National Committees

  6. - National committees comprising representatives from relevant government organizations and private sectors have been established. - All interested parties have been informed of their obligations under the TBT Agreement.

  7. Preparation of notification

  8. What to notify • Technical regulations • Conformity assessment procedures • Mandatory labelling requirements

  9. Find out about new proposed measures • reminders (every 3 months) • monitor the cabinet web site • advice from regulatory bodies • the media

  10. Necessary to notify: • relevant international standard does not exist • technical content is not in accordance with international standard • may have significant effect on trade of other Members

  12. When to notify: 1. Routine (Art.2.9): notify at an early appropriate stage, when a draft with the complete text is available ; when amendments can still be introduced and comments taken into account - comment period 60 days

  13. 2. Urgent problems (Art.2.10): - Safety, health, environmental protection, national security- notify immediately upon adoption

  14. How to fill in the notification form • only one form for both routine and urgent • detailed instruction in Section III : Notification procedures, G/TBT/1/Rev. ….… • information • - as complete as possible - no section should be left blank (latest)

  15. Submission of notifications • E-mail and mail to the Permanent Mission of Thailand to WTO • Permanent Mission of Thailand to WTO submit to crn@wto.org

  16. Notifying New Proposed / Revised Measures 1. Check for new proposed/revised measures or receive advice of new proposed measures 2. Assess if a Notification is required 3. Decide if it is TBT or both TBT & SPS 4. Decide when to notify 5. Complete Notification form 6. Submit to the WTO

  18. Up to October 2004, Thailand had notified 263 TBT notifications

  19. Specific difficulties and problems encountered • Insufficient awareness of the notification obligations at the operational level • It is sometimes difficult to distinguish whether it is under TBT or SPS Agreement • Notification form is not complete

  20. Specific difficulties and problems encountered (Cont.) • Some regulations are late notified as the • notification authority is informed after • the regulations have been adopted or • enforced due to differences in legislative • procedures of regulatory bodies- but late is better than never

  21. Proposals • Notifications should be checked for completeness and correctness according to the notification obligations before circulating to Members so as to avoid the same errors
