  2. SERIOUS DEFICIENCY • Denial of Applications and Termination - SA shall not enter into agreement with sponsors of any Federal CNP deemed seriously deficient - SA shall terminate a sponsor determined to be SD

  3. SERIOUS DEFICIENCY • SA shall afford reasonable opportunity for CA before termination • Sponsors can be reinstated if appropriate action has been taken to prevent recurrence of deficiencies

  4. SERIOUS DEFICIENCY • SD includes, but not limited to: 1) Noncompliance with application bid procedures and contract requirements of Federal CNP 2) Submission of false information to the SA 3) Failure to return to the SA advance payments which exceeded reimbursement

  5. SERIOUS DEFICIENCY • 4) Program Violations a. Noncompliance with the meal service time restrictions b. Failure to maintain adequate records c. Failure to adjust meal orders to conform with changing participation d. Simultaneous service of > one meal to any child

  6. SERIOUS DEFICIENCY • 4) Program Violation d. Claiming of meals not served to children e. Service of meals that do not meet program requirements f. Excessive instances of off site consumption

  7. SERIOUS DEFICIENCY • 4) Program Violations g. Continued use of FSMC in violation of health codes h. Any other violation of program requirements

  8. Termination and Disqualification • Serious Deficiency • Sponsor declared SD • Opportunity for corrective action • Incomplete corrective action • Propose to terminate agreement • Propose to disqualify • Termination of agreement by SA • Disqualification is primary consequence of termination – Placement on State DQ List

  9. Steps in SD Process • 1st - SD determination • 2nd - Notice of SD • 3rd - Opportunity for CA • 4th - Proposed Termination / Disqualification if CA is inadequate

  10. What is a Serious Deficiency? (con’t) • Two critical factors: Frequency and Severity • Frequency: How often does it occur? • Isolated error; or • Systemic problem

  11. The SD Notice • Fully describe the SDs • Outcome of corrective action • Corrective action deadline • Identify the Responsible Principals (RP)/Responsible Individuals(RI) • Sponsor is determined SD • Persons who cause the SD are RP/RIs
