  1. Documents Required For Court Marriage In India Every year, several marriages take place in India. These marriages are conducted and solemnized under the Special marriage act of 1954. This court marriage is conducted in the court under the supervision and guidance of a marriage officer. Also, three witnesses from both the bride and the groom’s side have to be present. The court marriage in Delhi can be conducted between two Indians, irrespective of their caste, creed, or religion. However, court marriage in India can also be made possible between an Indian and a foreigner. Conditions to be followed Since the court marriage is an entirely legal process, it has some conditions that must be abided by both the bride and the groom. Under section 4, the conditions levied for court marriage in India are as follows: ● Both the bride and the groom should not be a part of or should not fall under the degree of prohibited relationship. ● The marriageable age for a groom is 21 years, while that of the bride is 18 years in a court marriage in India. ● Both the parties should provide free consent for the court marriage. This means that none of the parties should be incompetent to produce valid consent due to their unsound mind or other factors. ● Either of the parties should not be involved in a persisting marriage with any other person. Both the bride and the groom can proceed with the court marriage only after they have obtained divorce from the previous spouse or when the previous partner is dead. ● Both parties must fulfill the eligibility conditions prescribed in the Special marriage act of 1954 before they sign the civil marriage contract. Documents required for court marriage In the court marriage process in Delhi, both the applicants have to produce some documents to proceed with the upcoming steps. The list of documents needed are as follows: Documents of bride and groom ● The marriage application form is signed duly by both the bride and the groom. ● Receipt of the fees paid. ● Affidavit. ● Residential address proof documents of both the bride and the groom (driving license, Aadhar card, ration card, or voter ID). ● Two copies of passport size photographs of both the bride and the groom. ● Age proof of both the bride and the groom can include a birth certificate or the SSLC book.   2. ● PAN card of the individual witnesses ● One passport size photograph of each witness. ● Proof of identification which may include a driving license or Aadhar card Documents for foreign national It may so happen that one from the couple may be a foreigner. In that case, these are the documents that need to be produced: ● Photocopy of the passport along with valid Visa. ● Documentary evidence regarding staying in India. Anyone from the bride and the groom has to submit this documentation. Also, this document has to prove that any one of the parties stayed in India for more than thirty days. One can submit proof of residence or a report from the concerned station house officer as a valid document. ● The foreigner has to submit a report from the concerned consulate or embassy, which will prove his marital status or NOC. Documents for affidavit The bride and the groom have to submit affidavits separately for the solemnization of the marriage. These are the documents required: ● Date of birth certificate ● Document proving marital status (whether divorced, married, or widowed) ● A statement that declares that none of the bride and the groom are related to the prohibited degree of relationships. If the court marriage is solemnized in Jammu and Kashmir, then it is mandatory for both parties to become Indian citizens first. This is mentioned in the Special Marriage Act of 1954. Court marriage fees The court marriage fees are charged differently in different places. In general, you can expect something between Rs. 500 to Rs. 1000. However, before you proceed with the whole process of court marriage in Delhi, you should check the fees or ask the marriage registrar. Conclusion Once the marriage is solemnized, the marriage registrar enters the details in his register. Also, the marriage certificate will be issued, which remains valid as long as you do not want a divorce or legal separation. So, taking care of this marriage certificate is essential.
