ELECTRONIC SIGNATURE - 1 • Government decision on the concept of e-signature regulation - August, 2000 • The act entered into force on September 1st 2001 • Ordinances based on the e-signature act • the designation of assessment bodies for electronic signature products (16/2001 Decree of the Minister of the Prime Minister’s Office) • the requirements concerning the operation of CSPs (15/2001 Decree of the Minister of the Prime Minister’s Office) • the procedures of the supervisory body (151/2001 Decree of the Government) • registration of electronic signature experts (7/2002 Decree of the Minister of the Prime Minister’s Office)

ELECTRONIC SIGNATURE - 2 • Based on the EU electronic signature directive • Main goals • Legal recognition for electronic signatures • Defines the operational requirements of certification service providers (CSP) • Introduction of an appropriate supervisory system for the secure operation of CSPs issuing qualified certificates

ELECTRONIC SIGNATURE - 3 Advanced e-signature • Based on qualified certificate • Created by secure-signature-creation device Qualified e-signature • uniquely linked to the signatory • capable of identifying the signatory • created using means that the signatory can maintain under his sole control • linked to the data to which it relates in such a manner that any subsequent change of the data is detectable electronic document fulfilling the requirements of written documents admissible as evidence Electronic signature handwritten signature (evidence with full probative force)

  9. ELECTRONIC SIGNATURE - 4 • Supervisory body is the Communications Authority of Hungary (www.hif.hu) • CSPs issuing ‘simple’ certificates to the public • already three notifications • GIRO Rt. (www.giro.hu) • MATAV Rt. (www.matav.hu) • NetLock Kft. (www.netlock.net) • some more expected during this year • CSPs issuing qualified certificates • one or two requests are expected this year
