New Marine Licensing • Provisions under UK Marine & Coastal Access Act 2009 • Replacing: • FEPA Part II • permission for extraction of minerals by marine dredging • marine works EIA requirements. • DOE licensing authority for inshore area (< 12nm) • Secretary of State authority for offshore area (and inshore for excepted matters)

Licensable Marine Activities • Previous FEPA activities • Deposit of substances / objects • Scuttling of vessels / containers • Incineration of substances / objects • More activities covered • Construction activities now specifically listed • All forms of dredging (except where approved under Harbours Order) • Removal of any substance or object • Deposit or use of explosives

  4. What will change? • Exemptions • Enforcement – range of notices • Compliance • Remediation • Stop / emergency • Sanctions – fixed & variable penalties • Appeals process

  5. Timetable • August – November: Consultation & evaluation • December – February: Assembly processes • April 2011: Legislation operational • NI legislation • Same timescales as Defra, Scotland & Wales
