  3. • Contractor meets Secretary of Labor’s Recruitment Plan.• Contractor completes Guam process• Secretary of Labor certifies to Governor that plan was met and Governor certifies to SECDEF that qualified workers are not available, per labor certification process. 2010 Defense Authorization Act RequirementsH-2B workers not allowed on projects unless:

Envisioned Temporary Labor Certification Process • Determine prevailing wage rate•File labor certification application•Obtain approval to begin recruitment – GDOL will ensure that 1(d) of the plan is met during review•Post job orders •Publish advertisements•Submit Recruitment Results•ALPCD Processing•Governor’s Certification

  5. Recruitment Standards (1a) Submit posting via internet to GES or submit form GES 514 in person • 60 days prior to the worker’s start date • Posted for at least 21 consecutive days • This posting will be commonly referred to as a DPRI Job Order

  6. (1b)Employer Job Order Posting THE EMPLOYER MUST POST THE JOB ORDER ON THE STATE WORKFOCE AGENCY’S INTENET JOB BANK FOR: • CNMI •American Samoa •Alaska •California •Hawaii •Oregon •Washington

  7. (1c)Submit a job posting with an internet based job bank GDOL will enter job postings into the NASWA National Labor Exchange

  8. RECRUITMENT REPORT No later than 30 days from start datesubmit results of all NDAA mandated recruitment to:ndaa.recruitment@dol.guam.gov

  9. Normal H-2B PROCESS for Guam

PRIOR RECRUITMENTThe employer must attempt to recruit US workers for the job opportunity prior to filing and document such efforts.FILING THE APPLICATIONEmployer files form GDOL 750 and supporting documents with the Guam Department of Labor.LABOR MARKET TESTINGThe employer must file a job order with the Guam Employment Service and recruit for a period of 30 days.

  11. PUBLISH ADVERTISEMENTSThe employer must publish a three consecutive working day advertisement, in the Pacific Daily News which directs applicants to apply with Guam Employment Service.ADJUDICATIONThe application will be adjudicated by the Alien Labor Processing & Certification Division and the Director of Labor makes a recommendation to the Governor who will certify or deny.

  12. USDOL and Guam DOL Recruitment Synchronization •Recruitment programs run simultaneously.•GDOL 750 form will be revised to allow for Secretary of Labor certification and Governor’s Cert to Secretary of Defense
