  3. Introduction • April 2006 – Government of India announcement on introducing 27% reservation Other Backward Classes (OBC) in central University including IIT’S, IIM’S etc. except Minority Institutions • This triggers off protests from Students community.

  4. Evolution of Reservation world over • The discrimination against groups of race, religion etc. are common problem with most of nations faced during evolution. • Religious tension in Northern Ireland and Bosnia • Race based discrimination in USA • Monitoring of Higher Education participation by • particular equity groups in Australia (See Table) • Origin of Caste System in India

Supreme court interpretation on Reservation • Supreme court (SC) interpretation of Article 13 and 29(2) of constitution – “ Fundamental Rights(FR) provided under part III, cannot be abrogated by any law.” • Keshavananda Bharthi case-1973, SC held that power of parliament to amend the constitution under article 368 is restricted in so far as it affects the basic structure of constitution

  7. Social Justice or Caste Justice • Social Justice is understood as Caste Justice in political context in India. • The interpretation aims at vote bank to maintain caste justice as an element of polarisation.

  8. Distribution of education seats on caste based reservation policy- India. * The percentage of reservation varied in each state depending upon the political situations of the state. E.g. Karnataka & Tamilnadu made reservations more than 50% .

Public Interest Litigation before SC • Reservation policy violates the basic structure of constitution which provides equality and prohibition of discrimination under article 14 and 29(2). • Special provision cannot take away F.R. under article 19 and discriminate between minority institutions and non minority institutions • Reference of institutions which are not covered reservation

Conclusion • Student is an important stake holder in education system. • There should be national debate on the whole issue of reservation before implementation. • Their Should be CET at all India level for various professional degree courses to avoid multiple appearance of CET. • Admission process should be made transparent, all admissions details are to be provided in the website of the institution • Teachers and academic administrators are to be sensitized against discrimination based on caste, class or gender.
