  2. Jurisprudence The study of law

  3. Jurisdiction the authority of a court to hear and try a case

  4. Concurrent Jurisdiction the authority of two or more courts to hear and try a case

  5. Exclusive jurisdiction when one court has the authority to hear a case over all other courts

  6. Appellate Jurisdiction the jurisdiction of a higher court to hear appeals of cases tried in lower courts

  7. Original Jurisdiction the right to hear a case for the first time

  8. Ex Post Facto Laws Punishing a person for an action that was not against the law when it was committed Article 1 forbids these

  9. Bill of Attainder A law that punishes a person accused of a crime without a trial or a fair hearing Article 1 forbids these

  10. Criminal Law Actions prohibited because they threaten, harm, or endanger the safety/welfare of the people

  11. Burden of proof Lies with the prosecution “Innocent until proven guilty”

  12. Grand Jury type of jury which determines whether there is enough evidence for a trial

  13. Petit Jury group of 12 jurors who determine guilt or innocence by listening to the facts as presented in a trial

  14. Bail a sum of money used as a security deposit to ensure that an accused person returns for his or her trial

  15. Plea Bargain negotiated agreement between the defense and the prosecution in a criminal case

  16. Indictment formal accusation of a felony issued by a grand jury after considering evidence presented by the prosecution

  17. Verdict the formal decision issued by a jury on the issues of fact that were presented at trial

  18. Defendant in criminal cases, the person accused of the crime

  19. Cross-Examination • Interrogation of a witness by the opponent side, follows direct examination of witness • (think 6th Amendment)

  21. Hung Jury In a criminal trial, when the jury is unable to reach a unanimous decision in the time allotted

  22. Capital Offense crime punishable by death

  23. Injunction Court order that commands a person to stop a certain action

  24. Summons Asks people to appear in court

  25. Subpoena A writ requiring people to appear in court

  26. Search Warrant Allows police to search someone’s private property

  27. Perjury Lying under oath

  28. Docket a calendar of the cases awaiting action in a court

  29. Civil Law Deals with disputes between individuals, victim seeks compensation for harm

  30. Plaintiff • the person who initiates a lawsuit • (like in criminal law, defendant is accused of wrongdoing)

  31. Mediation an attempt to bring about a peaceful settlement or compromise between two or more parties

  32. Arbitration the process to which both parties agree to let a neutral party decide the outcome of their dispute

  33. Negotiation the process to which both parties in a dispute try to work out a solution agreeable to both parties

  34. Compromise a settlement of differences in which each side makes concessions

  35. Collaboration to work together

  36. Debate discussion in which each party gives their side on the issues

  37. Consensus an opinion or position reached by a group as a whole
