Why Update the City Ordinance?

  • Old D.E.D and Oak Wilt ordinances reference State Statute Chapter 18 (Dept. of Agriculture)

  • Should reference State Statute Chapter 89 (DNR)

  • New Constitutional and case laws

  • To accommodate management of EAB, risk trees, and invasive species (e.g. buckthorn)

  • Move towards a basic “landscape health” ordinance


Updating Your Ordinance

  • What’s in Your Current Ordinance?

    • What is defined as a nuisance?

    • Who is responsible for implementing tasks?

  • What You Should Change

    • Include EAB

    • Possibly redefine nuisance

    • Possible responsibility shifts

    • Identify symptoms of EAB
