Background • Neighborhood Stabilization Program (NSP) was created to respond to rising residential foreclosures and property abandonment. • Board of County Commissioners (BCC) approved the County’s NSP Plan on November 18, 2008. • BCC approved resolution No. 2009-M-04 on February 17, 2009, authorizing the Housing and Community Development Division to acquire and convey properties under the NSP program.

Background • Section 125.35, Florida Statutes provides standards for a county regarding acquisition and disposition of real property. • State laws allows county to adopt alternative provisions regarding acquisition and conveyance. • Ordinance sets forth alternative methodologies for acquisition and conveyance of real property in order to accommodate the NSP.

Acquisition and Disposition of Real Property County authorized to sell and convey County property: • Board of County Commissioners determines • Notice published – Two weeks • Bid /highest bidder shall be accepted unless BCC rejects all bids as too low • Public meeting approval • Additional bids

  8. Acquisition and Disposition of Real Property Exceptions: • Insufficient size or shape to be a free standing lot • Value less than $15,000 • Of use to only one or more adjacent property owners • Notice to adjacent owners -10 days written notice • Sealed bids if more than one buyer

Acquisition and Disposition of Real Property Under the NSP Alternative Ordinance – Different Sale and Conveyance Standards: • Competition or qualifications standards – NSP standards • Reasonable public notice – private realtors • Form and manner as to how interested parties can acquire property • Negotiation procedures – NSP plan contemplates conventional loans • How people will be notified of final action • Comp Plan and zoning ordinance compliance required
