Appendix 1 - Process for listing community assets 8 weeks 8 weeks 8 weeks Voluntary / community group identifies ‘asset of community value’ Owner consulted Council decides not to list (decision recorded) Overturns original decision and removed from list and local land charge Council considers nomination (see note 1) Makes nomination to the council Owner decides whether to request and internal review Council decides to add to list and local land charges register updated Internal review mechanism Owner lodges an appeal considered by Tribunal Upholds decision Note 1 A building or other land should be considered an asset of community value if: its actual current use furthers the social wellbeing and interests of the local community, or a use in the recent past has done so; and that the use is not an ancillary one; and for land in current community use it is realistic to think that there will continue to be a use which furthers the social wellbeing and interests, or for land in community use in the recent past it is realistic to think that there will be community use within the next 5 years (in either case, whether or not that use is exactly the same as the present or past); and it does not fall within one of the exemptions e.g. residential premises and land held with them. ‘Social interests’ includes cultural, recreational and sporting interests.

Head of Housing and Planning considers nomination Decision not to list Consultation: Owner, Ward members Parish / Town council (if not the nominator) Recommendation to Localism and Communities Panel Nomination fits criteria. Nominator informed Managing Director makes decision in consultation with the Leader Owner decides whether to request an internal review Decision to add to list and local land charges register updated Request for internal review considered Following sale of property Owner makes compensation claim (13 weeks) Decision upheld Owner lodges an appeal considered by Tribunal
