  • Statutory – 1934 Communications Act and 1996 Telecommunications Act

  • Regulatory – Federal Communications Commission, National Telecommunications and Information Administration

  • Precedent – Red Lion, Prometheus, etc.

  • The three questions of doom:

    • Watch TV? Broadcasters and cable operators are regulated by the FCC

    • Use the internet? ISP’s are regulated by the FCC

    • Use your cell phone? Cellular providers are regulated by the FCC

    • 700 MHz auction rules/DTV transition

    • MDU exclusive contracts

    • Media ownership

    • Net neutrality

    • Broadband penetration/availability
