  2. Introduction • Minister’s speech of the May 2006 • Repealed Telecommunications Act 1996 • Proclamation of the Electronic Communications Act ( July 2006)

  3. National Objectives • Universal Service and access • Efficient utilization of spectrum • Infrastructure development and rollout • International Connectivity and • Broadband access

  4. Conclusion • Policy directions and decisions are gazette for public comments.

  5. Telecommunications Act issues • VANS • International Gateway facility for mobile operators • CDMA technology by USAL’s

  6. ECA • Conversion of current licences - VANS - Mobile operators - USAL’s • Section 5(6) for the Individual electronic communications network licences (Policy directions)

POLICY DESICIONS • SAT-3 Exclusivity provisions in the SAT-3 agreements or arrangements • Provision of wireless broadband by Sentech to Post Offices, Government offices, Thusong centres and others • SAPO post offices to be transformed into Thusong post offices • Mobile Broadcasting Services using the DVB-H standards

  9. POLICY DIRECTIONS • Prioritization of prescribing list of essential facilities to ensure that SAT-3 facilities are accessed immediately. • Increasing competition through conversion of other VANS licences into Individual Electronic Communications Network Services.

  10. -continue • Access to emergency communications, by end users in all circumstances. End users should be able to access the emergency services even if there is a default in payment. ICASA is to prescribe a list of the emergency numbers. • Allocation of spectrum for a single network for the national coverage for the provision of Mobile Broadcasting Services.

  11. -continue • ICASA to urgently prescribe regulations governing the co-ordinate between radio frequency spectrum licences • ICASA to urgently, prescribe procedures and criteria for awarding radio licences for competing applications or instances or where is insufficient spectrum

  12. -continue • USAL’s to be merged in to one Provincial Under Serviced Area Network Operator (PUSANO) licence where there is more than one licence. Equity ownership and control still to be held by persons from historically disadvantage groups in the designated licence area and must not be less than 51% • Ownership and control by persons or companies interested in investment shall be restricted to 49%.

  13. -continue • The implementation process of the Local Loop Unbundling should start immediately and be completed by 2011.
