EU e-signature policy Directive 1999/93/EC created the legal framework: Equivalence handwritten/electronic signature “third party” trust model free market approach + state supervision The Commission mandated CEN and ETSI to develop an EU e-signature standardisation framework --- The Commission took stock in 2006: Transposition OK but interoperability issues Adoption of an e-Signature & eID Action Plan(2008) ELRA, Brussels, 17.5.11 ••• 3

Improving eSignature interoperability within the current legal framework Recent progresses: “EU trusted list” of qualified signature certificates providers. 2009-2010 In the context of the Services Directive: Member States to process as a minimum, documents signed with ETSI formats. Member States to notify possibilities for free online signature validation. 2011 EU eSignature standards rationalisation mandate m460 to CEN and ETSI, 2011-2014 ELRA, Brussels, 17.5.11 ••• 4

Towards an eID, authentication, signature and related services policy • Objective: boost trust in the internet • Target: • secure and seamless e-interactions between businesses, citizens and public authorities.  • Digital Agenda for Europe COM(2010)245, 19.5.10: Key action 3: eSignature Directive revision … Key action 16: Decision on e-identification mutual recognition across the EU … • Reiterated by Single Market Act II COM(2011)206, 13.4.11: • Legislation ensuring eID mutual recognition across EU and e-signatures directive revision ELRA, Brussels, 17.5.11

  6. 1st step: Stakeholder workshop • Workshopon e-ID/e-signature 10.3.11, 80 persons • Objective: to gather views on: • the existing situation • potential solutions for easy access and secure transactions • Summary on website • Main points raised: • Clarify Directive 1999/93/EC • Improve trust • Increase usability • Cover new signing scenarios (mobile, mass signing, …) • Need for standards • Technological neutrality • International dimension ELRA, Brussels, 17.5.11

  7. 1st step: Public online consultation • Consultation on e-ID and e-signature, 18.2-15.4.2011 • To gather views on: • the existing situation • potential solutions for easy access and secure transactions • Results soon on eSignature website ELRA, Brussels, 17.5.11

  8. 1st step: Public online consultation • Overall picture: • 455 contributions (418 online, on which statistics are based) • 50% organisations, 50% individuals • 79% respondents use eSignatures and eID • Main usage: to secure transactions and guarantee documents integrity. • 51% of the respondents use "qualified" eSignatures • Contrasted perceptions of the current issues at stake • Contrasted opinions on priority areas to be addressed however: • 56% against 20% agree on a need for EU eID legislation • 82% indicate need to address eSignature and eID through mobile devices. • 61% against 25% support eConsent in EU legislation ELRA, Brussels, 17.5.11
