Native Americans in the Southeast • White settlers “pushing” Native Americans to the west – American Westward expansion • Many Native Americans still living East of the Mississippi River. • White settlers wanted the Native American lands… not that many people live west of Mississippi – not “good” for farming, give it to Indians …

Jackson’s Removal Policy Indian Removal Act • 1828 - Gold found on Cherokee/Native American land in Georgia • 1830 - Indian Removal Act Jackson & US Congress wanted the land east of the Mississippi river to give it to the American settlers for farming & mining. So they signed a law to forced Native Americans to leave their lands and moved into “Indian Territory”

  14. Indian Territory • An Indian Territory was created – territory west of the Mississippi river / now Oklahoma, Kansas & Nebraska • Indians were forced to move there / lost their land.

Georgia • Supreme Court Case Cherokee Nation / Native Americans vs. state of Georgia) • Background: State of Georgia passed laws to take over Native American lands. • Cherokee Nation sued state of Georgia • Decision: Chief Justice –John Marshall ruled Cherokees are an independent people, so they won’t have to follow Georgia’s laws • Jackson & state of Georgia ignored the ruling • “If Marshall ruled that way… let him enforce his ruling”… Jackson will not enforce the law!!!!

  16. Trail of Tears • Forced march of Cherokee people- Native Americans from their lands in Georgia into a new Indian territory. (Oklahoma) • Many Indians died on the march . ( about ¼)
