CVFPB and U.S. Interaction • Cooperate with the U.S. Army Corps of Engineers (USACE) in building and operating State Plan of Flood Control Facilities [§8615] • Provide (without cost) all lands, easements, and rights-of-way necessary for construction of the project under the adopted plan of flood control [§8617(a)] • Hold and save the U.S. free from damage due to construction works [§8617(b)] • Maintain and operate all works in accordance with regulations prescribed by the Secretary of Defense [§8617(c)] • Participate with the USACE under PL 84-99 to restore or repair flood-damaged works after a flood • CVFPB provides the Corps with necessary rights-of-way and relocations

  3. Flood Management Authorities (1/2) • Establish a standard of levee construction [§8598 (a)] • Establish and enforce standards for maintenance and operation of flood management works along the Sacramento River, the San Joaquin River, their tributaries, and related areas [§8608] • Approve and adopt a schedule for mapping areas at risk of flooding in the Sacramento River and San Joaquin River drainage by December 31, 2008 and annually thereafter [§8612] • Designate and administer floodways throughout the Sacramento and San Joaquin Rivers drainage [§8609] • Provide oversight of flood management facility operation and maintenance [§8617(c)]

  4. Flood Management Authorities (2/2) • Regulate encroachments on the flood management system [§8700 et seq.] • Approve or deny plans for reclamation or flood control, drainage, improvement, dredging or work, that includes or contemplates the construction, enlargement, revetment or alteration of any levee, embankment, canal or other excavation in the bed of or along or near the banks of the Sacramento or San Joaquin Rivers or any of their tributaries [§ 8710, 8712, 8713, 8718] • Construct, clear, and maintain bypasses, levees, canals, sumps, overflow channels and basins, reservoirs, and other flood control works [§8590(b)] • Construct, maintain, and operate ditches, canals, pumping plants, and other drainage works [§8590(c)]

  5. Planning Authorities • Approve and adopt a Central Valley Flood Protection Plan [§9612] • Adopt a status report (by DWR) for the State Plan of Flood Control [§9120] • Help establish a system of mitigation banking by which mitigation credits may be acquired in advance for flood control work to be performed related to the State Plan of Flood Control [§8613] • Investigate and evaluate, in cooperation with the department, the feasibility of potential bypasses or floodways that would significantly reduce flood stage in the San Joaquin River Watershed, upstream and south of Paradise Cut [§9613(c)] • Review and comment on local flood emergency management plans, and updates to general plans based on the Central Valley Flood Protection Plan [§9621 et seq., §9650, §65302.7]

  6. Collaboration Authorities • Collaborate with State and federal agencies, if appropriate, regarding multi-objective flood management strategies that incorporate agricultural conservation, ecosystem protection and restoration, or recreational components [§8590(e)] • The Board, other state agencies, cities, counties, and districts are authorized to cooperate with one another and with the agencies of the United States in the performance of channel clearing and desnagging work within the Sacramento and San Joaquin Rivers and their tributaries, and may furnish money, services, equipment and property to that end [§8539] • Participate in developing and implementing federal flood protection projects in the Central Valley with local agencies [§12648 et seq.]

  7. Legal Authority • The board may maintain actions in the name of the people of the State to restrain, or to recover damages for, the doing of any act or thing that may be injurious to any of the works necessary to the plan of flood control or that may interfere with the successful execution of the plan. [§8596] • Maintain any actions in the name of the people of the State to restrain the diversion of the water of any stream that will increase the flow of water in the Sacramento or San Joaquin Rivers or their tributaries [§8598(c)] • Hear and adjudicate complaints on flood control matters [§8730 et seq] • Make contracts in the name of the drainage district to indemnify or compensate any owner of land or other property for any injury or damage caused by the exercise of the powers conferred by this division, or arising out of the use, taking, or damage of any property for any of the purposes of this division. [§8590(d)] • Disburse funds for maintenance and rehabilitation of Delta levees maintained by local agencies (Delta Levee Subvention Program)

  8. Property/Real Estate Authority • Acquire property necessary for flood management [§8590(a)] • Rent, lease, sale, exchange, or in payment for work done or services rendered, of any land, property, material, equipment, or any other thing in the possession of the drainage district, which, in the opinion of the board, is no longer needed for the purposes of flood control works or other necessary or convenient purposes [§8598(d)]
