  2. PLANTEAMIENTO. • Presunción de inocencia. Derecho subjetivo público fundamental ( ART. 24.2 CE, 137 LRJ) • Administración: carga de acreditar los hechos constitutivos de la infracción y la responsabilidad del presunto infractor. • A través de una actividad probatoria de cargo con todas las garantías, cuya ausencia o ineficacia determina la ilegitimidad de la sanción.

  3. PLANTEAMIENTO. • Prueba de cargo: terminante, clara e indubitada. Obtenida de forma legítima y practicada con las formalidades legales al respecto. • Medios de prueba: documental, confesión, inspección ocular, pericial, testifical e indicios. • Momentos de obtención: actuaciones de investigación previas; en el expediente ( actuaciones complementarias, periodo de prueba).

  4. PROBLEMÁTICA • Ámbito de las facultades de supervisión e inspección. • Negativa a la actuación de inspección. • Oposición de derechos fundamentales. • Cooperación internacional. • Valoración del material probatorio.
