  2. I am married to a non-Canadian. I have returned to Canada and he or she is living in his or her own country.

  3. At this point, I wish to sponsor my spouse to come to Canada. Is our physical separation going to present problems?

  4. While living together helps prove the genuineness of your marriage, in some cases, physical separation can’t be avoided.

  5. Work duties may require you to reside in Canada.

  6. Also, you may be subject to a requirement to reside in Canada to maintain permanent resident status or to acquire citizenship.

  7. As well, your immigration status in your spouse’s home country may prevent you from residing there.

  8. If you have a reasonable explanation for your physical separation and can demonstrate that you are still a couple, then you should be able to make your case to CIC.

  9. Under such circumstances, I would recommend spending as much time with your spouse as possible.

  10. You should visit with your spouse in his or her country or in a third country to which you can both travel.

  11. You should also send regular emails to your spouse and call your spouse from a phone (so that you have a record of calls).

  12. You may also consider applying for a visitor visa for your spouse, although you might have a hard time getting this approved.
