The Construction Products Directive Objectives of harmonization • facilitate the free circulation of goods in the Internal Market, without reducing the existing and justified safety levels in the Member States and other Countries concerned • contribute to the improvement of the competitiveness of enterprises in Europe Budapest 2003-10-30

The Construction Products Directive A complex New Approach Directive • Harmonizing test methods and product declarations - NOT harmonizing regulation as such • Essential Requirements a frame work for national regulation on construction works - NOT on products • Harmonised Technical Specifications on products mandatory - no alternative to reach CE marking • Regulation on design and execution of works - national competence, different safety levels allowed Budapest 2003-10-30

  14. Mandates Commission Mandates are given, after consultations with MSs, to: • CEN for hENs • EOTA for ETAGs > ETAs Budapest 2003-10-30

  15. Technical Specifications II • CE marking mandatory against 38 hENs • CE marking possible against 49 hENs • another 400 hENs are expected • CE marking possible against 15 ETAGs • 155 ETAs given so far • more to come Budapest 2003-10-30

CE Marking The goal - CE marking • Signifies that the product satisfies all the provisions of the CPD (and other applicable CE marking directives) • i.e. the product complies with a European technical specification and has been subject to the appropriate conformity assessment procedures • The product is fit for the intended use • CE marking is done by the manufacturer or his representative Budapest 2003-10-30

  20. CE Marking CE marking - good for business • Common European test methods and procedures • One single assessment valid throughout Europe • Automatic presumption of conformity if technical specification are complied with • Permits voluntary « added value » marks Budapest 2003-10-30

CE Marking Additional quality markings • A product may bear additional markings, provided that they: • fulfil a different function from the CE marking • are not liable to cause confusion with it, and • do not reduce its legibility and visibility • Such marks cannot be made obligatory in the regulations of the Member States - they are voluntary and market driven Budapest 2003-10-30

Tasks I • MSs to provide legislation, making CE Marking mandatory when possible and providing a relevant infrastructure • National Standards Body and Approval Body to provide harmonized Technical Specifications based on European documents • Notified Bodies to carry out Assessment for Attestation of Conformity, engaged by Manufacturer • Manufacturer / importer / provider to take the responsibility for his product and the CE marking Budapest 2003-10-30
