Current situation • high cost of OTM authorisation/ homologation/ certification – up to 20 % of product • long time of OTM authorisation for placing into service - up to one year or even more • with some exception – no cross – acceptance of authorisation even for the same type of machine • and many more details… EFRTC GM, Florence, 03.12.2010

5. OTM relevance • Interoperability Directive 2008/57 • OTM within scope but application is not mandatory NA are free to apply their specific rules • Safety Directive 2004/49 • No obligations for contractors to implement SMS • Safety is a matter of contract between IM/RU and contractor • Compliance with ERTMS but only for new vehicles • ERA regulatory framework • - Non existing for OTM as specific category • CEN and CENELEC standards • Voluntary domain only mandatory if included in national standards or as EC/TSI core parameters EFRTC GM, Florence, 03.12.2010

Some examples of problems encountered • already presented in in general at last GM in Paris by EFRTC President • but here documented by specific examples as delivered by contractors and industry • see appendices to the paper • more examples and quantifications are still expected to be gathered • ERA is asking for quantification of the size of the OTM market in relation to the costs encountered for taking actions in regulatory framework EFRTC GM, Florence, 03.12.2010

7. Summary – basic requirements (1) • OTM - small numbers dedicated to work and not run on the network, so not in the same category as locomotives or wagons • OTM – mobile factory/plant and not vehicle, so either outside EC Directive or as specific case in the Directive • application of TSI – no cost increase but simplifications, cost and time reduction • transparency of authorisation and clarity of assessment criteria in all EC regulatory framework and national reference documents EFRTC GM, Florence, 03.12.2010

8. Summary – basic requirements (2) • type certification against TSI by manufacturer to be Europe-wide acknowledged – re-checking strictly limited • specific national requirements to be declared and known in advance in national reference documents to be accepted by ERA • exception for X-acceptance – only unique, complex and specific track machines tailored to customer • Review of current EN 14 033 should be a starting point for OTM authorisation and x-acceptance EFRTC GM, Florence, 03.12.2010

9. Actions taken and way forward • EFRTC position paper was drafted as asked by Board and completed taking into account the outcome of the joint meeting of EFRTC Committees and industry • GM is now asked to agree that it should serve as a basis for future actions towards NSA and other stakeholders • subject GM approval EFRTC Board shall call for the meeting with NSA of major European countries (F, G, I, UK) EFRTC GM, Florence, 03.12.2010

ERA seminar on cross acceptance (1) • Objective • to exchange information on mutual recognition and the way railway vehicles are authorised in Europe • to understand ERA recommendation DV 29 on the authorisation for placing into service structural subsystem and vehicles under the Directive 2008/57/EC before its approval and publishing by EC • Participants • ERA - Executive Director, Dept. Directors and staff concerned, senior administrators from government and NSA, UNIFE, CER, EIM, ERFA and also EFRTC EFRTC GM, Florence, 03.12.2010

Other issues • Technology • TSI revision – EFRTC invited to participate at kick off meeting organised by ERA on 07.11.2010 • proposal to ERA for setting up a specific task force for OTM composed of the experts from contractors, OTM supply industry and IMs (and probably later also from NSAs) . • TF OTM would then deliver recommendations for TSI WPs and other relevant bodies outside of Directive • ERRAC and EC research • Auto – Main project approved for EC funding • Efficient railway infrastructure call and proposal EFRTC GM, Florence, 03.12.2010
