  6. 4-month AFC • Purpose - Peaking projects • Data adequate by Dec. 31, 2001 • On line by Aug 2002 • Projects • No public health or safety concerns • Mitigated environmental impact • No significant adverse energy system impact • Comply with legal requirements • Have a contract and skilled labor • Address disproportionate impacts • Control site

  7. Emergency Permit • Who Qualifies? • Peaker power plant • On line by September 30, 2001 • ISO Summer Reliability Contract • 50 MW or larger • No fatal flaws

Emergency Permit • Length of CEC license • Life of project if: • contract with CDWR or CAISO • meets continuation criteria at end of contract: • meets BACT and has permanent air emission offsets • compliance with all Energy Commission conditions • site control, and • project is a permanent facility. • 3 years with option to recertify w/o contract

Emergency Permit • Purpose - Peaking projects • Fatal Flaw Analysis • No public health or safety concerns • Mitigated environmental impact • No significant adverse energy system impact • Comply with legal requirements • Have a contract and skilled labor • Address disproportionate impacts • Control site • No or minimal linear facilities • Exempt from CEQA requirements
