  1. Summer in the City  - Riots: damage and BI‬‪. A presentationto LBIA 6th February 2012 by Jonathan Clark, Technical Director Cunningham Lindsey

  2. My themes today • International picture • Communication • BI issues • Riot Damages Act

  3. International picture • Thailand – anti-government • Egypt – Arab Spring • Rome – anti-greed protests

  4. Communication • Clear language • What does this mean for me? • 5 days in August • Co-ordinated response • By the industry • By the rioters – targeted key shops • Tune in to the incident • Employees abandoning premises for safety • Moving high risk stock • Some non-riot activities

  5. BI issues • Wide area damage – other circumstances • Denial of access • Safe to start trading again? • Loss of attraction – whole parade demolished in London Road Croydon • Early closing and boarding up? • Extensions – do they require MD proviso to be satisfied?

  6. Riot Damages Act What is a riot? - Public Order Act 1986: “12 or more persons present together, using or threatening unlawful violence for a common purpose and their conduct (taken together) is such that it would cause a person of reasonable firmness present at the scene to fear for his personal safety” • Is this a riot? • Is BI covered • Alternative trading costs? • Loss of profit / revenue? • 14 days to submit the claim – extended to 42 days • Time limits don’t work for BI • Agree claims for recovery before test case on BI?
