NPRR 379: EEA Level 2 Dispatch • NPRR 379 approved by the Board on Sept. 20 • Effective date: Oct. 1, 2011 • Includes new language providing ERCOT operators with flexibility to dispatch EILS or Load Resources in either order, depending on conditions • Sec. 6.5.9.4.2 (2)(a)(ii): • Instruct QSEs to deploy available contracted EILS Loads and/or deploy RRS supplied from Load Resources (controlled by high-set under-frequency relays). ERCOT may deploy EILS or RRS without deploying the other, and may deploy both services simultaneously or separately, and in any order. ERCOT shall issue such Dispatch Instructions in accordance with the deployment methodologies described in paragraphs (iii) and (iv) below. • Replaced language that would have required ERCOT to dispatch EILS first • Situational awareness – close monitoring of system conditions – continues to be critical for EILS QSEs EILS Update

NPRR 379: TDSP Notifications • New Section 3.14.3 (24) also added per ERCOT Comments: • (24) At least 24 hours before an EILS Contract Period begins, ERCOT shall provide each affected TDSP with a list of EILS Loads and members of aggregated EILS Loads located in the TDSP’s service area that will be participating in EILS during the upcoming EILS Contract Period. TDSPs shall maintain the confidentiality of this information. • This provision added by ERCOT at the request of multiple TDSPs, citing need to better manage firm load shed rotations and potential local congestion issues EILS Update

Rule 25.507 • ERCOT Staff has been working with PUC Staff on potential Rule changes • Provisions would include: • Allowing participation by DG and CHP • Automatic re-up option for new Contract Period if EILS is exhausted • Eliminating the 1 MW minimum offer requirement • Eliminating the 1,000 MW cap requirement • Next steps: brief Commissioners and determine best strategy for expediting rulemaking process • Goal is to have rules in place prior to Summer 2012 Contract Period EILS Update
