  2. Thesis Homosexuals in America should be able to marry and receive the same benefits as heterosexuals because DOMA was proved unconstitutional, it would allow homosexual couples to have the security and benefits that heterosexual couples have, and it would not devalue marriage.

  3. What is DOMA? DOMA is the Defense of Marriage Act. There are two main parts of DOMA. Section 2: Nowhere in the country is it required to award the right for same sex marriages to occur; if the marriages do become legal, that marriage does not have to be treated as a traditional one. Section 3: DOMA legally defines that marriage is the union between a man and a woman.

  4. Unconstitutional The Obama Administration announced in February 2011 that it would no longer support or preserve DOMA in court. DOMA violates the Fifth Amendment; which states, “Among other things, no person shall be ‘deprived of life, liberty, or property, without due process of law.’” Section 3 violates the equal protection component of the Fifth Amendment.

The differentiation demeans the couple, whose moral and sexual choices the Constitution protects… and whose relationship the State has sought to dignify.”

The Supreme Court declared that in the states where it is legal for gay couples to get married, the federal government will award those couples with federal benefits.

  7. Not Promoting Equality As a country that claims to extol quality, we are not promoting or demonstrating it at all. There is a stigma against same-sex couples. Not allowing homosexuals to get marries sends them a message that they aren’t as good as everyone else and it makes it “acceptable” to discriminate against them.

Adoption Opponents claim that if you can’t naturally procreate, then you should not be able to get married. “A study in June of 2010 found that children of lesbian mothers were rated higher than children of heterosexual parents in social and academic competence and had fewer social problems. This same study also found that children of gay fathers were ‘as well adjusted as those adopted by heterosexual parents.’ As Washington Post columnist Erza Klein argues, ‘We should be begging gay couples to adopt children. We should see this as a great boon that gay marriage could bring kids who need nothing more than two loving parent.’”
