  2. Consultation • Draft SEN Code published 4 October 2013 • 174 pages • Send responses before 9 December 2013 • SEND reforms in place from September 2014

  3. New SEN Code of Practice is legally binding on: • Local authorities (Education, Social Care, Housing, Employment and other services) • Early Years providers • Schools • Further Education Colleges • 6th form Colleges • Academies, including Free Schools • Independent and Non-Maintained Special Schools • Pupil Referral Units and other Alternative Provision • NHS England • Clinical Commissioning Groups • NHS Trusts • NHS Foundation Trusts • Local Health Boards • SEND Tribunals

  4. Some parts of the new SEN Code are legally binding and some are just recommendations • Where the Code states ‘must’ these sections are a statutory requirement • Where the Code states ‘should’ these sections are considered best practice

  5. We must have regard to: • the views, wishes and feelings of the child or young person, and their parents; • the importance of the child or young person, and their parents, participating as fully as possible in decisions; and being provided with the information and support necessary to enable participation in those decisions; • the need to support the child or young person, and their parents, in order to facilitate the development of the child or young person and to help them achieve the best possible educational and other outcomes, preparing them effectively for adulthood.
