WHO IS COVERED?

Temporary Work Agencies:

  • Supplies workers to third parties (hirers) on temporary basis

  • Has a contract with the worker but does not give any direct instructions to the worker


Who is covered (2)

The Temporary Worker:

  • Contract between agency and worker

  • No permanent placement

  • Subject to supervision and direction of hirer

  • Cannot be in business on their own account


Who is covered (3)

The Hirer:

  • Company

  • Partnership

  • Sole trader

  • Public body


Out of scope

  • Genuine outsourcing arrangements

  • The genuinely self-employed

  • In-house staffing banks

  • Toilet / shower facilities

  • Access to a workplace creche

  • Access to company transport facilities
