  3. WHO IS COVERED? Temporary Work Agencies: • Supplies workers to third parties (hirers) on temporary basis • Has a contract with the worker but does not give any direct instructions to the worker

  4. Who is covered (2) The Temporary Worker: • Contract between agency and worker • No permanent placement • Subject to supervision and direction of hirer • Cannot be in business on their own account

  5. Who is covered (3) The Hirer: • Company • Partnership • Sole trader • Public body

  6. Out of scope • Genuine outsourcing arrangements • The genuinely self-employed • In-house staffing banks

  7. DAY ONE RIGHTS Access to collective facilities and amenities: • A staff common room • Toilet / shower facilities • Access to a workplace creche • Access to company transport facilities

  8. Collective facilities and amenities • Objective justification: cost? impractical? organisational nightmare?

  9. DAY ONE RIGHTS Access to information on job vacancies Fair treatment in accessing vacancies is NOT fair treatment in selecting employees
