  1. Technical Advisory Committee Update COPS July 12, 2011 & RMS July 20, 2011

ERCOT Board Update • NPRR312, Clarification of QSE Requirements for Split Generation Resources – Urgent • Remanded to TAC due to Market Participant’s comments were added and approved by TAC to this NPRR after it was filed by ERCOT. • ERCOT removed the graybox language that was added by TAC that incorporated Sandy Creek’s comments. The motion was to approve NPRR312 as originally submitted by ERCOT without Sandy Creek comments: • TAC Approved the motion • Comments from Brad Jones (TAC Chair): • In the future if there are comments that need to be considered by the Board prior to their voting then that individual or company should use the appeal process to ensure that their comments are being recognized and considered by Board members. This is the reason why the appeal process was created to give Market Participants an avenue to voice their objections, comments and/or concerns to the Board.

Protocol Revision Subcommittee (PRS) Update • Nodal Protocol Revision Requests (NPRRs) Vote: • NPRR299, Remove Requirement for ERCOT Board Approval of PUCT, IMM, and FERC Required Reports • Approved by TACwith 1-abstention and 0-opposed • NPRR313, Updating the Term Resource Plan to Current Operating Plan/Availability Plan (formerly “Updating the Term Resource Plan to Current Operating Plan”) • Unanimously Approvedby TAC with same Priority and Rank as approved by PRS

Protocol Revision Subcommittee (PRS) Update • Nodal Protocol Revision Requests (NPRRs) Vote: • NPRR348, Generation Resource Start-Up and Shut-Down Process • TAC Approved Remanding back to PRS due to a Market Participant identified an issue that would negatively impact their operations with the current proposed language • NPRR355, Adjust the Calculation of the Real-Time Settlement Point Price for a Load Zone • Unanimously Approvedby TAC with same Priority and Rank as approved by PRS

Protocol Revision Subcommittee (PRS) Update • Nodal Protocol Revision Requests (NPRRs): • NPRR362, Changes to PRC Calculation • Unanimously Approved by TAC • NPRR376, CRR Volume Limitation Enhancements Urgent • Unanimously Approvedas amended by TAC with a Critical Priority and Rank of 9.6 • NPRR387, Hydro RRS Deployment Under Frequency Relay Set Point – Urgent • Unanimously Approved after approving NOGRR068 as amended by ERCOT along with LCRA comments.

Protocol Revision Subcommittee (PRS) Update • SCR766, Load Zone Price Distributed by ICCP • TAC Unanimously Approved with same Priority and Rank as Approved by PRS. • NPRR340, Introduction and Definition of Duration-Limited Resources (formerly “Unannounced HSL Test for Duration-Limited Resources”) – Urgent • Unanimously Approved Tabling NPRR340 for one-additional month to allow WMS to complete their work.

  8. 2012 Project Prioritization List • Motion: TAC Endorses the 2012 Project Priority Rank by Project Category as recommended by the Protocol Revision Subcommittee (PRS): • TAC Approved the Endorsement of the 2012 Project Prioritization List with 1 abstention and 0 opposed

Notice of PRS Rejections • NPRR309, Providing STWPF to QSEs Contractually Affiliated with WGR • NPRR351, Calculate and Post Projected Non-Binding LMPs for the Next 15 Minutes • NPRR363, Revision to EEA Level 2B ERCOT Requirements During the EILS VDI • NPRR367, Shaping of PTP Options Taken to Real-Time to Match Forecasted Load – Urgent • NPRR368, Clarification of the Purpose of Point-to-Point Options – Urgent • NPRR378, Posting of the ERCOT Short-Term Load Forecast and the Aggregated HDL and LDL Used in SCED

  10. Impact Assessment for Parking Deck NPRRs • NPRR258, Sync with PRR824 and PRR833 and Additional Clarifications • TAC Approved NPRR258 -- with 1 abstention and 0 opposed with a Priority of Critical and Rank of 8.5 same as approved by PRS

Impact Assessment for Parking Deck NPRRs • The following 3 NPRRs were Tabled by TAC to wait for 6 additional NPRRs to go through the Stakeholder process to allow the Board to receive them all in one package: • NPRR222, Half-Hour Start Unit RUC Clawback • NPRR241, Aggregate Incremental Liability (AIL) Calculation and Credit Reports Publish Corrections • NPRR256, Sync with PRR787, Add Non-Compliance Language to QSE Performance Standards

Reliability and Operations Subcommittee (ROS) Update • NOGRR058, Deletion of Section 5, Planning • Unanimously Approved to Table NPGRR058 for 1 month until after the Board considers PGRR005 for approval that develops a new process into the Planning Guides before deleting Section 5. • NOGRR063, Additional Method for Submitting Back-up Control Plans • TAC Unanimously Approved • NOGRR064, QSE Acknowledgement of VSS Dispatch Instructions • TAC Unanimously Approved

  13. Reliability and Operations Subcommittee (ROS) Update • NOGRR066, ERCOT WAN Connection Termination Requirement • TAC Unanimously Approved • NOGRR068, Hydro-Responsive Reserve- Urgent • TAC Unanimously Approvedas amended by ERCOT and with LCRA’s comments • PGRR005, New Planning Guide Section 4, Planning Criteria (formerly “New Planning Guide Section 5, Planning Criteria”) • TAC Unanimously Approved • Note: TAC will wait for Board Approval of PGRR005 before considering NPRR058 for approval that deletes Section 5, Planning.

  14. Wholesale Market Subcommittee (WMS)Update • Quarterly Emerging Technologies Integration Plan • TAC Unanimously Approved as written • Day Ahead Market Collateral Parameters Process • TAC Unanimously Approved • Holistic Approach to Congestion Irresolvable by SCED • WMS has tabled a motion to set shadow price caps based on the ERCOT/Luminant approach, but with a price floor of $2,000. • The motion to table was to allow additional discussion and consideration of the approach. • WMS will continue discussion at its next meeting.

  15. Other Subcommittee Updates • Commercial Operations Subcommittee (COPS) had no voting item(s) this month, therefore Debbie McKeever’s report to TAC was only an update of COPS’ recent activities. • Retail Market Subcommittee (RMS) had no voting item(s) this month, therefore Kyle Patrick’s report to TAC was only an update of RMS’ recent activities.

  16. Additional TAC Updates: • Commodity Exchange Act Exemption Issue • CFTC Joint ISO petition hasn’t been finalized and several issues still being discussed amongst the parties involved. The other ISOs are beginning to circulate their requirements • Reducing the settlement timeline – two things being discussed through the stakeholder process that may put ERCOT in a better position to be compliant with Frank/Dodd and FERC requirements: • NPRR347 looking at reducing initial settlement timeline from 10 days to 9 days, which is being discussed with SEWG and CWG—expected to be at the Board in September and • NPRR391 that will reduce payment due date by 3 days – should go to the ERCOT Board in October. This NPRR was recently introduced to the market and currently going through the stakeholder processes.

  17. Additional TAC Updates • Phase 1 Department of Energy Long-Term Study Report • Requesting market feedback – DOE is asking for comments on the posted interim reports and participation in the on-going study • Discussion will be held at the Regional Planning Group meeting on July 15, 2011 and at additional meetings as needed. Comments can be submitted through August 10, 2011. • Comments can be sent to: Longtermstudy@LISTS.ERCOT.COM

  18. Future TAC Agenda Item • Annual TAC and TAC Subcommittee Structure Review • Kick-off meeting scheduled on July 20, 2011, but start time was undetermined as of the 7/7/11 TAC meeting. • Location: McKinney Roughs at LCRA facilities in Bastrop, TX • Attendance: All interested parties – Lunch will be provided but attendees will need to pay $10.00 per plate if planning to eat lunch. • Scope of the meeting will be to determine the future need for continuing the same level of Subcommittees/Working Groups/Taskforces as current with the outcome being a proposal for discussion and/or consideration by the ERCOT Board.
