Applicability • Applies to development of all property within Innovation Way unless otherwise exempt Exemptions • A single-family house on a single-family lot of record • Development consistent with future land use and zoning designations existing as of June 13, 2006 • Land located within a Rural Settlement as of June 13, 2006 • Land owned by Orange County, the City of Orlando, the Expressway Authority, or the State of Florida or its agencies • Development with a consistency vested rights determination provided the vested rights do not expire

Action Requested Determine that the proposed Ordinance will not have a substantial impact on the development of real property in Orange County, make a finding of consistency with the Comprehensive Plan and adopt Ordinance 2010-04, the Environmental Land Stewardship Program for Innovation Way. Additionally, grant staff the authority to correct any scrivener’s errors when the Ordinance is finalized.

HT/HV jobs and industries defined • High tech manufacturing industries and services in the fields of medicine, engineering, science, clean tech industries, especially those dedicated to research and development • High value jobs in any industry with average annual salaries that exceed 115% of average Orange County wage

Additional Provision • For projects with an approved development program • To be added to the end of Section 30-758 (f) Nothing in this section or article shall be construed to require the owner or developer of a development program contained in a PD-LUP or Comprehensive Plan Policy FLU8.1.4 approved prior to May 1, 2010, to seek entitlements in addition to those existing on that date in order to satisfy or meet the requirements of this section or article.  Nevertheless, such owner or developer shall not be excused from having to designate and reserve high tech/high value industry lands as required by this section for entitlements existing as of that date.
