Article 12Equal recognition before the law • Legal capacity: (1) the capacity to have rights & duties • (2) the capacity to excercise rights & duties • Art. 12: all persons with disabilities have legal capacity (1) & (2) • Human rights model of disability: legal capacity is a human right and cannot be denied or restricted on the basis of impairment • Right to have legal capacity recognized everywhere • Right to support for excercising legal capacity

  3. Art. 19 Living independently and being included in the community • Right not to live in an institution or special residential area • Right to independent living services • Right to have access to all community services available to the general public

Meaning for service providers • Deinstitutionalization • Community – based services • Individualized (independent living) services • No more substitute decision making (abolish forced treatment and forced institutionalization (see art.14) • Develop and offer supported decision making services • Help to build accessible local communities
