Results • Current draft is a Commission Decision based on WFD Annex V Section 1.4.1 • Current situation may change due to the alignment to new comitology procedure, “regulatory procedure with scrutiny” • Other options are possible, e.g. a Commission report • DG ENV preference is still to have a Commission Decision through comitology

  6. Key issues • Current focus should be on getting the substance right, the format for publication is less important • No matter what is the format of publication, Member States are obliged to apply the results in establishing the good ecological status boundaries (Annex V, Section 1.4.1, paragraph (iii)) • The Commission is working in a proposal to align the WFD to the new comitology procedures. The outcome of this discussion will have to be considered when deciding on the format

Discussion • Open issues are currently under discussion at the WFD Committee • It is important that the Water Directors are aware of these developments • The Water Directors are invited to • Take note and discuss the state of play • Take note on the developments on the new regulatory procedure with scrunity
