U.S. Coast GuardClaims and Litigation The Military Personnel and Civilian Employees’ Claims Act (MPCECA): • See COMDTINST M5890.9, Chapter 6. • Provides authority for settlement of claims for the loss of, damage to, or destruction of certain property of military personnel or civilian employees occurring incident to their service. • For incidents occurring primarily aboard Government property, or as a result of duty-related activities. • Does not replace private insurance.

U.S. Coast GuardClaims and Litigation • Claims by military members or civilian employees of the Coast Guard, are under the MPCECA, and should be submitted on the CG-4112, Personal Property Claim form. • These types of claims do not normally require full administrative investigations. Instead, units should use the CG-4112A, Claims Investigating Officer’s Report of Personal Property Claim. • Page 2 of the CG-4111, which is an inventory sheet, may also be requested by the Settlement Officer when the claim involves damage to several items.

U.S. Coast GuardClaims and Litigation The Investigation: As soon as possible after an incident that might give rise to a claim against the Coast Guard, the responsible unit should undertake an investigation in accordance with the Administrative Investigations Manual (AIM), COMDTINST M5830.1 as supplemented by Chapter 2 of the Coast Guard Claims and Litigation Manual, COMDTINST M5890.9. In most claims matters, the preferred investigation format is the Letter Incident Report (LIR). Enclosure 6 of the AIM provides a Sample LIR and Enclosure 11 gives an investigation check-off list.

  7. U.S. Coast GuardClaims and Litigation Note: LSC-5E is solely responsible for the adjudication of all MPCECA claims Coast Guard-wide (except those arising from the transportation or storage of household goods).

  8. U.S. Coast GuardClaims and Litigation Claims arising from the transportation or storage of household goods (HHG) in connection with a permanent change of station are handled separately and should be forwarded directly to: Coast Guard Finance Center HHG Claims P.O.
