Petty theft - short explanation • In a variety of legal systems, petty theft is a criminal offense in the field of criminal offenses against property. There are some legal sistems where petty theft is even treated as a violation, too. • In any case, in determining this offense, it is important that the value of the stolen goods is lower than the arbitrary and that there was an intention to inflict petty damage. • Petty thefts are big problem in everyday life of citizens. Police department statistic • According to data from the Police Directorate, the fact is that 8776 thieves were arrested over the previous 5 years. • Among those 1800 are repeaters. • We do not have a precise figure, but mostly the perpetrators committed petty thefts. Most common petty theft objects • According to information from the Police Directorate, police and citizens are facing with thefts of bicycles, wallets and car parts, especially car batteries, food items in markets, even supplies in churches, etc. on daily basis.   5. Criminal Code Article 246 Anyone who commits a petty theft, embezzlement or fraud, shall be punished by a fine or an imprisonment sentence not exceeding six months. Theft, embezzlement or fraud are considered petty if the value of things stolen or embezzled i.e. damage caused by fraud does not exceed the amount of € 150, and the perpetrator intended to make small property gain i.e. to cause small damage. For an act as of Paragraph 1 of this Article, if it is committed to the detriment of citizens, prosecution is undertaken by a private action.

  6. Regulation in comparative law • Slovenia – Categorises, theft depending on the value of the stolen thing. The law system provides two types of punishment which include fines and imprisonment sentence. • Serbia – provides identical solution to Montenegrin law that includes fines, but there is arbitrary value 5000din and it is about 3 times less than here. Regulation in comparative law • Sweden – Swedish criminal law also regulates petty theft depending on the value of the stolen object, the punishment also includes imprisonment sentence and fines • Italy – Italian law divides petty theft into two parts and provides a fine from 154 to 516 euros depending on the situation II.
