The IMF said global growth would reach 3.3 per cent in 2020, com- pared to 2.9 per cent in 2019, which was the slowest pace since the fi- nancial crisis a decade ago. Estimates for both years were cut by 0.1 per- centage point from fore- casts made in October. It has cut back its 2020 global growth forecasts due to the slowdown in India and other world markets. There is a silver lining to this dark cloud, though. It said a US-China trade deal is a signal that trade and manufacturing activity will bounce from its low soon. The IMF predicts global growth would reach 3.3 percent in 2020, compared to 2.9 percent in 2019, which was the slowest pace since the financial crisis a decade ago. Estimates for both years were cut by 0.1 percentage point from forecasts made in October. Growth will improve slightly to 3.4 per- cent in 2021, but that estimate, too, was cut by 0.2 percentage point from October, the Washington-based international crisis lend- er said. What does this imply for the world? One, we should all brace for a pe- riod of low income, fewer jobs and more competition between countries as they vie for more income. Two, it means the world is moving towards a period of uncertainty around traditional business models. The growth forecasts sug- gest technology is slowly hitting traditional ways of doing business. Though it is not vis- ible at the moment, historians would note one day that this slowdown was part of a process that upended businesses through technology Three, the message for India is that it is now a high stakes player in the growth game. What happens here has a global impact. Though this is something to feel great about, India should also note it has to address is- sues that plague its growth. It has to find ways to put more money into infrastructure projects and generate more jobs. The economy is going through a cycli- cal slowdown. In a few months, it is bound to bottom out and start an upward cycle. India can’t afford to remain a lag- gard for long. Once the trend reverses, it would be embarrassing for India if growth here remains sluggish. A few days from now, the Indian finance minister will present the budget for the next fiscal. The government is trying to turn India into a dollar 5 trillion economy by 2024. But, the bigger challenge is to take the country back to the high growth rates from the past decade. Not just India, but the world awaits. The strategy of lowering taxes for corpo- rations has not worked. It has not led to more investments and jobs. The onus now is on the government to revive the economy and, thus, the global sentiment. W e are aware that in the past years, in urban areas of the country , number of illegal con- structions have been raised and even today are being raised speedily, not only be encroach- ing upon government lands but, by the private persons also on their buildings either by raising multi-story constructions or changing the nature and use of building from dwelling house to commercial use, etc. Every day, the news is ap- pearing in the newspapers re- garding illegal constructions in big cities. The officers of the concerned State Governments are summoned in the courts and directions are given to them.In this regard, we should abreast ourselves with the lat- est law laid down by the Su- preme Court of India. In AIR 2013, Supreme Court 1861, Esha Ekta Apartments Co-operative Housing Society Ltd. And Ors. V. Municipal Corporation of Mumbai and Ors., the Supreme Court has delivered a land- mark judgment on the point “whether illegal construction done by the builders by en- croaching upon government land as well as on private land also against bye-laws and by private persons also on their private buildings against bye- laws should be regularized or not” and the Supreme Court had categorically held that the illegal constructions could not be regularized by any authori- ty in any manner and nor could be compounded. The Supreme Court has also observed that in the last five decades, the provisions contained in various munic- ipal laws of planned devel- opment of the areas to which such laws are applica- ble have been violated with impunity in all the cities, big or small, and those en- trusted with the task of en- suring implementation of the master plan, etc., have miserably failed to perform their duties. Supreme Court has further held that the flat buyers had consciously occupied the flats illegally constructed by the developers/builders and the only remedy available to them is to sue the lessee and the developer/builder for re- turn of the money and/or for damages and they cannot seek a direction for regular- ization of the illegal and un- authorized made by the developers/ builders. It has also been held that no authority administering mu- nicipal laws and other similar laws can encourage the viola- tion of the sanctioned plan. The Supreme Court further held that the Courts are also expected to refrain from ex- ercising equitable jurisdic- tion for regularization of illegal and unauthorized constructions, else it would encourage violators of the planning laws and destroy the very idea and concept of the planned development of urban as well as rural areas. The ratio of above discus- sions of judgments of the Su- preme Court is that the illegal constructions cannot be regu- larized or compounded. THE VIEWS EXPRESSED BY THE AUTHOR ARE PERSONAL In the case of Friends Colo- ny Development Committee v. State of Orissa (2004) 8 SCC 733, the Supreme Court observed that the builders violate with impunity the sanctioned build- ing plans and indulge in devia- tions much to the prejudice of the planned development of the city and at the peril of the occupants of the premises con- structed or of the inhabitants of the city at large. A serious threat is posed to ecology and environment and, at the same time, the infrastructure consisting of water supply, sewage, and traffic movement facilities suffer unbearable burden and are often thrown out of gear.It was further observed in the judgment that unwary purchasers in search of a roof over their heads and purchasing flats/apartments from builders, find them- selves having fallen prey and become victims to the de- signs of unscrupulous build- ers. The builder conveniently walks away having pocketed the money, leaving behind the unfortunate occupants to face the music in the event of unau- thorized const ructions being detected or exposed and threat- ened with demolition.In Royal Paradise Hotel (P) Ltd. On being asked about his visit to Jaipur, the lyricist of ‘Hasi Ban Gaye’ said, “I love the life of Mumbai but I keep coming back to Jaipur because my roots are here.” Kunal has given many super hit songs not just in Bollywood but in Rajasthan too. He has worked with Rapperiya Baalam and Mohit Gaur for many Rajasthani songs. “When I was young, I used to write poetry while listening to the music and eventually, I started growing in- terest in music. Later I realised that poetry is a lot more different than music.”, said the Star Screen Award nominee. The popular song ‘Tum Hi Aana’ from the film ‘Marjaavaan’ is writ- ten by Kunal Verma along with many other songs from the movies like ‘Malang’, ‘Street Dancer 3D’, ‘Race 3’, to name a few.
