Overview of Current Mass Transition Process in effect until 12-31-06 • ERCOT Legal Department advises Retail Client Services (RCS) of a PUCT approved Mass Transition Event (default or voluntary) • RCS sends Notification Email of mass transition to affected CR, POLRs, TDSPs • RCS sets up Initial Conference Call for next business day and coordinates with Retail Customer Choice (RCC) and Energy Analysis and Aggregation (EAA) to announce: • Global Esi Id counts • Global Load info • Distribution counts amongst POLRs and TDSPs • Effective date of transition/POLR submission date/TDSP completion date • Disable CSAs • COB of Conference Call day • Provide POLRs/TDSPs with Esi Id list by email • Coordinate Customer Info if available (cooperative or non-cooperative status) • Legal Department approved Market Notification of Default (not voluntary) • Per Rule- Exiting CR and POLRs send notices to end use customers • POLRs begin submitting transactions with FASD • Pending Orders notification to affected CRs (including cancellations) • Sponsor daily Conference Calls for updates/issues • Roll Call to discuss submits, cancels, scheduled, and completes • Send Daily email updates of transition progress • Latest tally of transaction progress • Declare Transition Event Complete and send email to mass transition contacts

Overview of Mass Transition Process – what changes after 1/1/07 • ERCOT Legal Department advises Retail Client Services (RCS) of a PUCT approved Mass Transition Event (default or voluntary) • RCS sends Notification Email of Mass Transition (Notification Day) to affected CR, POLRs, TDSPs • RCS sets up Conference Call for next business day and coordinates with Retail Customer Choice (RCC) and Energy Analysis and Aggregation (EAA) to prepare, distribute, and announce: • Global Esi Id counts • Global Load info • Effective date of transition/POLR submission date/TDSP completion date • Disable CSAs • COB of Conference Call day • “Manually” distribute Esi Ids to POLRs (confidential) • Manual bifurcation of Small and Medium non-residential • Ensure non-discriminatory assignments to Voluntary and Non-Voluntary POLRs • Provide TDSPs with Esi Id list by email • Coordinate Customer Info if available (cooperative or non-cooperative status) • Legal Department approved Market Notification of Default (not voluntary) • Per Rule- Exiting CR and POLRs send notices to end use customers • POLRs begin submitting transactions with FASD • Pending Orders notification to affected CRs (including cancellations)

Overview of Mass Transition Process – what changes after TX SET 3.0 • ERCOT Legal Department advises Retail Client Services (RCS) of a PUCT approved Mass Transition Event (default or voluntary) • RCS sends Notification Email of Mass Transition (Notification Day) to affected CR, POLRs, TDSPs • RCS sets up Initial Conference Call for next business day and coordinates with Retail Customer Choice (RCC) and Energy Analysis and Aggregation (EAA) to “trigger” automated process and prepare, distribute, and announce: • Global Esi Id counts • Global Load info • Effective date of transition/POLR submission date/TDSP completion date • Disable CSAs • Calendar day 0 • ERCOT will systematically generate 814_03s for the mass transition event Esi Ids with consideration of: • Bifurcation of Customer Classes (Small and Medium non-residential) • Ensure non-discriminatory assignments to Voluntary and Non-Voluntary POLRs • Calendar day 1 • Transactions flow • Distribute Esi Id list to POLRs (confidential) • Exiting CR has three business days to provide Customer Info to POLRs. If none is to be provided, ERCOT will send information from last update file. • Provide TDSPs with Esi Id list by email

Overview of Mass Transition Process – what changes after TX SET 3.0 • Per Rule- Exiting CR and POLRs send notices to end use customers • Next Business day- Hold initial conference call to announce steps taken on Calendar Day 0, unless Calendar Day 0 and first Business Day are the same • Legal Department approved Market Notification of Default (not voluntary) • Pending Orders notification to affected CRs (including cancellations) • Sponsor daily Conference Calls for updates/issues • Roll Call to discuss transition progress based on percentages rather than exact counts to protect confidentiality of POLR distribution • Send Daily email updates of transition progress • Latest tally of transaction progress based on percentages • Any follow-up necessary on confidential exact counts of POLRs • Declare Transition Event Complete and send email to mass transition contacts

End of Term – Exiting POLR process • ERCOT communicated to all current POLRs requesting they submit their lists no later than 12/1/06. • ERCOT received confirmation from all current POLRs as of 11/20/06 • 6 will not be transitioning any POLR customers • 2 will be transitioning POLR customer • Total of 294 ESI IDs from the 2 lists received • Outgoing POLRs are to provide the file formatted with data elements detailed in Retail Market Guide Appendix G, POLR Transfer Template.  All unused fields must be blank.

End of Term – Exiting POLR process • ERCOT will perform the manual bifurcation of the Small non-residential and Medium non-residential POLR classes. • ERCOT will perform the allocation process with the Volunteer POLR REP and Non-volunteering POLR REP as outlined in the rule (manually). • Determine total volume of ESI IDs to be transitioned per POLR Customer Class/TDSP combination. • Use POLR allocation spreadsheets to allocate ESI IDs to the Volunteer and Non-Volunteer POLRs. • Sort ESI IDs numerically. • Randomly order the CRs to assign ESI IDs to (random # generator is in the spreadsheet). • Send lists to the POLRs via email – 2 files – 1 with customer data, 1 with ESI IDs.

  10. End of Term – Exiting POLR process • ERCOT will provide ESI ID lists to the incoming POLRs via email. • No later than 12/15/06 • Incoming POLRs are to submit on-cycle switches with customer protection provisions waived to gain the customers.

Customer Billing Information Process - Current • Current process (will continue until TX SET 3.0) • ERCOT will distribute customer billing information provided by defaulting REP to POLRs. • Data from defaulting REP is to adhere to format specified in RMG Appendix F5, however files have varied in format. • ERCOT does not attempt to alter the format of what we receive when it does not adhere to format in Appendix F5. • ERCOT will break the data up based on the ESIIDs assigned to each POLR. • ERCOT will send the customer billing information as a separate Excel attachment on the same outbound email message where we are providing our ESIID list to the POLR. • Where the defaulting REP is uncooperative – the TDSPs are to provide the POLRs with any customer data they have on file.

Customer Billing Information Process – After TX SET 3.0 • After TX SET 3.0 (reference RMGRR 042, section 7.11.6) • Semi-Annual submission of customer billing contact information • CR shall submit twice a year a complete customer billing contact information file. • Create and submit between 1st and 15th of April • Create and submit between 1st and 15th of October • Files shall be submitted via NAESB • ERCOT will send response via NAESB • Appendix F6 for File Layouts

Customer Billing Information Process – After TX SET 3.0 • After TX SET 3.0 (reference RMGRR 042, section 7.11.6) • Retention of semi-annual customer billing contact information • ERCOT will retain the data from the last semi-annual submission, to be used in lieu of data from the exiting CR, in instances where the exiting CR does not provide such data. • ERCOT will safeguard the Customer billing contact information in accordance with Protocol section 1.3 Confidentiality.

Customer Billing Information Process – After TX SET 3.0 • After TX SET 3.0 (reference RMGRR 042, section 7.11.6) • Submission of customer billing contact information during Mass Transition event • Upon the initiation of a Mass Transition event, ERCOT will request that the exiting CR provide Customer billing contact information for all ESI IDs which the exiting CR serves. • CR shall submit timely and complete files • Files shall be submitted via NAESB • ERCOT will send response via NAESB • Appendix F6 for File Layouts

Customer Billing Information Process – After TX SET 3.0 • After TX SET 3.0 (reference RMGRR 042, section 7.11.6) • Sending Customer Billing Contact Information to Gaining CR during Mass Transition event • Upon receipt of the Customer billing contact information from the exiting CR during a Mass Transition event, ERCOT shall provide each gaining CR with available Customer billing contact information for the ESI IDS each gaining CR will be receiving through the mass Transition Event. • ERCOT will send files via NAESB • Appendix F6 for File Layouts

Customer Billing Information Process – After TX SET 3.0 • After TX SET 3.0 (reference RMGRR 042, section 7.11.6) • Sending semi-annual customer billing contact information to Gaining CR when no file is received • Should the exiting CR fail to send current Customer billing contact information, ERCOT will distribute information received in the last semi-annual report submission no later than three (3) Retail Business days after the Mass Transition notification. • In instances where information is not provided through a current or stored file, the gaining CR shall request that the TDSP provide any relevant information it its possession. • ERCOT will send files via NAESB • Appendix F6 for File Layouts

Customer Billing Information Process – After TX SET 3.0 • After TX SET 3.0 (reference RMGRR 042, section 7.11.6) • Reporting by ERCOT to PUCT • ERCOT will provide a confidential report to the PUCT by 1st of May and November of each year, the following information will be included on the report: (1) Name and DUNs Number of CRs who submitted semi-annual Customer billing contact information files: (a) Date of file submission; (b) Number of rows provided by CR; (c) Count of ESI IDs ERCOT has associated with CR; (d) Total number of mandatory fields expected from CR; (e) Number of mandatory fields provided by CR; and (f) Number of mandatory fields not provided by CR. (2) Name and DUNs Number of CRs that did not submit reports: • Count of ESI IDs ERCOT has associated with CR.
