  2. THE CONTEXT • 550 000 Km2 • 60 Million Hab • 6000 fatalities/year • 7 to 8 million alcohol test/ year • 181 000 positive in 2004 • 30 – 35 % fatalities related to alcohol

  3. Number and average of drivers with a positive alcohol detection involved in a road accident, regarding to age and B AC (Source : ONISR – 2005)

  4. ALCOHOL RELATED SANCTIONS IN FRANCE IN 2005(Ministry of Justice SDSED)

  5. Alcohol related offences: (2 levels) • >0.5 g/l (blood) or 0.25 mg/l(Breath) • <0.8 g/l(Blood)or 0.4 mg/l(Breath) : • Fine, suspension of licence only if justice decision • 6 pts from the Driving Licence • > 0.8 g/l(Blood)or 0.4 mg/l(Breath): • Fine up to 4500 €, Jail up to 2 years, Suspension up to 3 years(max), Cancellation possible if other offence, injuries or fatalities • And 6 pts

  6. The suspension of the driving licence : 3 phases • Police: Retention 72 hours maxi • Prefect (Administration): Suspension with a scale linked with the BAC, maxi 6 months, can refuse alternative sanctions • Justice: Final suspension (or revocation) 1 2

The pilot Program • Alternative program to penal sanction (only legal possibility in the current legislation) • Under the control of the prosecutor • Led by the Road Safety Association of Haute-Savoie • Voluntary base • Paid by the offender (1260€) • A training course (2 days) • 6 months Program

  8. The pilot Program • Local initiative • Followed by the parliament, the administration and the ministries • Coordination between the Prosecutors, the prefects, and the Prevention Routiere • Evaluation by the CERMT • Datas given to the INRETS for external evaluation (DRUID project)

  9. Two Partners (now through a common structure) • Alcoolock (ACS) • Draeger

  10. The setting • 6 months program • 2 X 1 day of training course 0.015 setting • Data control every 1 up to 2 months • Management of incidents within 5 days • Final report to the prosecutor

  11. 1st Phase First offenders BAC : > 0,4 mg/l, < 0.9 mg/l (Breath) > 3 years of Driving Licence < 65 years Medical assessment by a certified MD prior to the inclusion No heavy drinkers, No drugs No occasional drinkers 2nd Phase First offenders BAC : > 0,4 mg/l, < 1mg/l mg/l (Breath) > 3 years of Driving Licence No age limit, decision by the prosecutor Medical examination by the medical commission prior to the inclusion No heavy drinkers, No drugs Occasional drinkers can be included The criteria for inclusion

  12. The evolution • Road safety association’s director certified as delegate of the Prosecutor • Administrative management with the support of the Prefect (national file of DL, medical examination) • Only one structure to manage the partners ACS and Draeger

  14. The driving licence !! • Strong demande from the Police forces to identify the drivers in the program • No legal possibility to write or print on the licence • DL included in a plastic envelope with a seal • With a mention about the program

  16. Actually • 50 drivers in the second phase • Major Violations : 0 • Exclusion of the programm : 0 • Positive detections: 80% happened during the 2 first months • Delay due to the elections in France (President and Parliament)

  17. A bigger interest since the 6th IIS in Annecy

  18. Next steps (1st of september 2007) • 3 justice courts (Annecy, Bonneville, Thonon-les-Bains) • Proposition to 12 other justice courts and general extension depending of other justice courts and prefects • A set of new laws to include in sanctions, probation, • Discussion about a « second level » program for heavy offenders, accidents, recidivism (program 1 year or more) • Training course pushed to 3 days, • Euroalcolock program? • Commercial program in school buses under discussion

  19. The Training Course • Half a day before starting : training, basic information, procedures, interfering substances • 2 days before M3: traffic safety, alcohol related accident, psychology of the driver) • Half a day at the end
