Competent Authority • Since November 2006, The competent authority for environmental issues was the Ministry of Tourism and Environmental Protection to the 20.11.2008.god. • On the basis of Article 10 of the Law on Environment (Official Gazette. List of Montenegro "No. 48/08) and the Decree on Amendments to the Regulation on organization and working methods of public administration (" Official Gazette of Montenegro "no. 68/08) 12 . 11. 2008th year, established the Agency for Environmental Protection. This Regulation entered into force 20.11.2008.- 8 days from publication in the Official Gazette. • Under this Regulation, Agency took part of the Affairs and officials from the Ministry of Tourism and Environmental Protection and the Ministry of Health, Labor and Social Welfare.20.11.2008- Beginning of work of the Environmental Protection Agency.

Art. 10 of the Law on Environment stipulates: • Professional and related administrative activities in the field of environmental protection shall authority body responsible for Environmental Affairs (Agency). • In conducting Agency: issue permits, monitor, makes analysis and reports, perform inspection tasks and makes communication with the relevant national and international bodies and organizations, as well as with the public, and perform other duties stipulated by this Law and special regulations. • The Agency cooperates with international bodies and organizations of other countries dealing with environmental protection, particularly with the European Environment Agency, the International Atomic Energy Agency, participates in the work of professional networks within the European Union, as well as with similar agencies in other states. • Funds for the Agency provided from the budget of Montenegro and donations.

  5. Article 40 of the environment and art. Regulation 44c-Cadastre of polluters • AD Aluminum - Podgorica, one of the most important entities that are subject to regular inspection controls as one of the pollutants • Cadastre of polluters of the environment contains information on sources, the type, amount, manner and place of discharge, transfer and disposal of pollutants and waste into the environment. • Integral Cadastre of polluters lead agency on the basis of local environmental pollutants cadastre leading local government units. • Closer to the content and manner of maintaining the cadastre, the taxpayer, the manner and terms of collection and submission of data on emissions and discharges, and other data of importance for the cadastre prescribed by the Ministry. • Bylaws are still not made. • Working group formed is responsible to work on the formation of the cadastre of pollutants.

Monitoring • Monitoring is an integral part of a unified information system environment • Is implemented in order to obtain reliable and quality information about the state of the environmentIt is a base for making appropriate and timely decisions, establishment of information systemDefines priorities in environmental management • Government makes the monitoring program which is proposed by the Agencies, for a period of one year. • Units of local government may, in accordance with the law ,organize environmental monitoring. • The state provides funds for performance monitoring.

Monitoring of paragraph 1 of this article includes monitoring: • Immissions and air quality, water, sea, land, flora and fauna as well as the exploitation of mineral resources; • Environmental pollution and emissions in the environment; • Impact of environmental pollution on human health; • Impact of significant segments of the sector on the environment;

Natural phenomena, and tracking and monitoring of meteorological, hydrological, erosion, • seismological, radiological and other geophysical phenomena • State of preservation of nature • State noise and waste, the early announcement of random pollutions, as well as commitments from international agreements; • Other phenomena that affect the state of the environment; type shows, Emissions, natural phenomena, which are subject to monitoring, measurement and layout of the place, scope and frequency of measurements, indicators of environmental pollution, the methodology of sampling and measurements, terms and manner of delivery of data, how informing the public, shall be regulated by government regulations.

Implementation of monitoring Article 34.:Monitoring is conducted by the Agency.For the immediate tasks of monitoring the implementation of the Agency may employ other legal and natural persons.Criteria and conditions for conducting monitoring are regulated by government regulations.All the subjects of environmental protection in Article 7 this Law shall, at the request of the Agency, submit data and information for Keeping Information System
