  2. 2008 Legislative session • 47CSR2 WQS Triennial review passed March 6, 2008 • Governor signed on March 28, 2008 • Rule filed with Secretary of State on April 11, 2008, effective date July 1, 2008 • Rationale document will be sent to EPA for approval in July 2008

  3. Changes during Legislative session • The proposed additions to the trout water list were removed • Removal of Tier 2.5 and change in the definition of Tier 3 waters

  4. High points of triennial review • Nutrients criteria, including phosphorous and chlorophyll-a, for both warm and cool water lakes • Dissolved aluminum warmwater chronic value of 750 g/l was passed, replacing the emergency rule which expires September 14, 2008 • Criteria for four parameters in Appendix E were updated based on EPA recommendation

  5. 16 parameters added to Appendix E with WQS limits based on EPA’s Current National Recommended Water Quality Criteria • Formulas in Appendix E used to calculate aquatic life limits for metals, were updated to reflect current EPA recommendations • Use Removal of Category A and D1 designations on Pats Branch

  6. Timelines for 2009 Proposed Rules • June 10, 2008 – Proposed rules delivered to Advisory Council members • June 24, 2008 – Advisory Council meets at 1:30 pm • July 1, 2008 – File notice of public hearing and public comment period with Secretary of State • August 18-25, 2008 – public hearing • August 29, 2008 – Last day to file Agency approved rule with Secretary of State

  7. Proposed rule revision for 2009 • Category A revision
