  2. Probleem 1: Rechtsonzekerheid • Art. 9.3 Vw. bepaalt geen inhoudelijke criteria criteria voor regularisatie • Invulling van criteria behoort tot ‘discretionaire bevoegdheid’ van Minister BiZa • Gevolg: verschillende omzendbrieven • Gevolg: arbitraire beslissingsmacht bij DVZ

  3. Oplossing 1: Duidelijke criteria • Wettelijke vastlegging van criteria: discretionaire bevoegdheid van Minister wordt ‘gebonden’ • Individuele invulling van criteria: betrokkene wordt persoonlijk gehoord

  4. Probleem 2: Disfunctioneren van administratieve overheid • Beslissing op basis van dossier • Geen termijnen vastgelegd • Geen beroep ten gronde mogelijk

  5. Oplossing 2: Eerlijke behandeling van elke zaak • Geen beslissing op basis van dossier, betrokkene wordt gehoord door ambtenaar • Vastlegging wettelijke termijnen • gemeente: 10d • DVZ: 6m, dan: A.I.

  6. Oplossing 2: Eerlijke behandeling van elke zaak • Administratieve beroepsmogelijkheid • onafhankelijke rechtbank • inhoudelijk beroep • schorsend beroep • debat op tegenspraak • rechten van verdediging • ontlasting van RvSt
