  2. BACKGROUND CASE: BZA # VA-07-09-014 APPLICANT: CBS Outdoor ZONING: C-2 (General Commercial) TRACT SIZE: 100 ft. x 109 ft. LOCATION: West side of South Texas Avenue, north of West Church Street, east of State Road 408 DISTRICT: #6

  3. APPLICANT’S REQUEST Variances in C-2 zone as follows: • To construct billboard 50 ft. in height in lieu of 40 feet; and • To allow 1,825 ft. distance separation from another billboard in lieu of 2,640 ft. Note: Applicant proposes to remove 3 billboards and construct 1 new billboard.

  10. STAFF ANALYSIS • Applicant will remove a total of 3 billboard signs and replace with one new billboard • Sound wall erected along State Road 408 reduced the visibility of the applicant’s billboard sign • The request is compatible with surrounding land uses

  11. BZA FINDINGS • The variance requests will not adversely impact the surrounding area • Consistent with past approvals granted by the BZA for height variances • No opposition present at BZA public hearing

  12. BZA RECOMMENDATION Approved the variance requests in that the BZA found the requests complied with the requirements of Section 30-43, Orange County Code. (Unanimous 6-0 vote)

  13. BCC ACTION REQUESTED ACTION REQUESTED: Approve the request consistent with the Board of Zoning Adjustment’s recommendation with the following condition.

  14. BZA CONDITION Within 30 days of final inspection, applicant shall remove 1 billboard located on Parcel I.D. 28-22-29-0000-00-033 and 2 billboards located on Parcel I.D. 28-22-29-9200-03-100, as referenced in letter dated July 11, 2007.
