BACKGROUND CASE: VA-13-08-055 APPLICANT: Wallack Holding, LLC REQUEST: Request for parking variances in C-1 and C-2 zoning districts as follows: 1) To allow 311 parking spaces in lieu of 410 spaces 2) To allow off-site parking 1030 ft. away from subject site in lieu of 300 ft. away ZONING: C-1 and C-2 TRACT SIZE: 2.89 acres LOCATION: Southwest corner of W. Sand Lake Rd. and International Dr. DISTRICT: #6

  15. PROJECT DATA • Original plaza (Hollywood Plaza) was permitted in 1994 • The plaza has 5 buildings on-site (Walgreens, Golden Corral, Kobe, TGI Fridays/Bargain World and Comfort Inn) • Proposal is to renovate and increase square footage of the TGI Fridays/Bargain World building from 43,361 sq. ft. to 67,857 sq. ft. • TGI Fridays will convert to Mangos (an entertainment night club) • Mangos and Bargain World require 410 parking spaces • They are proposing 311 parking spaces (deficiency of 99 spaces) • Variance #1 is applicant’s preference; if Variance #1 is not approved they are requesting an off-site satellite parking lot 1030 ft. away (Variance #2) • The off-site satellite parking lot will accommodate 363 parking spaces • The off-site satellite parking lot is not a parking garage • Applicant submitted a parking study by a traffic engineer • The entire Hollywood Plaza has a cross-parking easement agreement for shared use of parking by all tenants, less 63 spaces for Walgreens exclusive use

PARKING DETAILS • Hollywood Plaza has 497 parking spaces • Parking Demand (per code): • Mango’s/Retail – 410 • Kobe – 62 • Walgreens – 79 (63 exclusive use) • Golden Corral – 108 • Comfort Inn – 80 Total Need – 739 parking spaces Total Available – 434 parking spaces (497-63 Walgreen) Deficit – 305 parking spaces Proposed Satellite Lot – 363 spaces

  17. COMMUNITY FEEDBACK • 5 persons spoke in favor • 2 persons spoke in opposition • 2 written commentaries in favor • 5 written commentaries in opposition

BZA FINDINGS • BZA supported the redevelopment project • BZA acknowledged the existing parking concerns for the businesses on International Dr. • Off-site satellite parking lot is reasonable provided it is restricted as to use • Until a long term solution is found, the off-site satellite parking lot with the restrictions was a reasonable compromise

  19. BZA RECOMMENDATION DECISION:Denied Variance request #1 in that the BZA found it did not meet the requirements governing variances outlined in Section 30-43(3), Orange County Code. Approved Variance request #2 in that the BZA found it met the requirements governing variances as spelled out in Section 30-43(3), Orange County Code. Said approval is subject to 5 conditions of approval (5 in favor; 0 opposed; unanimous)

  20. BCC ACTION REQUESTED ACTION REQUESTED: Deny Variance #1 request and approve Variance #2 request with conditions consistent with the Board of Zoning Adjustment’s recommendation.

BZA CONDITIONS • Pursuant to Section 125.022, Florida Statutes, issuance of this development permit by the County does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of the permit if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that result in a violation of state or federal law. Pursuant to Section 125.002, the applicant shall obtain all other applicable state or federal permits before commencement of development. • Employees and staff shall park at the satellite parking lot. • Satellite parking lot shall be used for valet parking and buses. • Shuttle buses shall be provided from the satellite parking lot to Mangos. • Valet parking spaces shall be located at the satellite parking lot. • The satellite parking lot parcel is restricted to parking lot use only for Mango’s, there shall be no other development permitted on the parcel unless alternative code compliant parking is provided for Mango’s.
