Notes LEGAL RESPONSIBILITIES The Occupational Health and safety plan is part of any business management system where quality, environment and safety is one of the keys for great success in business. Upper level management should ensure that the quality safety and environmental policy are at the core of the overall business strategy and policy. Roles, responsibilities, authorities, evaluation criteria and analytical method, documentation and maintenance for processes and services should be defined. Changes to the policy should be planned and implemented ensuring the integrity of the system. This informatiuon also needs to be communicated to employees, management groups, contractors and suppliers. This in turn ensures that a stable relationship with all stakeholders is maintained. The obligation for compliance rests with not only the company but those persons that manage and supervise company operations. Defences against breaches of the ACTS are extremely limited. Breaches of regulations can lead to prosecution. In all jurisdictions the responsibility rests with the employer to ensure the environment, health and safety and welfare of all persons at work.
