  3. Adult Reentry Grant Program Senate Bill 840 $50,000,000 Competitive grants to community-based organizations (CBOs) Support for people formerly incarcerated in state prison ARG Program

  4. Funding is to be awarded to CBOs for the three project components: $25,000,000 for rental assistance; $9,350,000 to support the “warm hand-off” and reentry of offenders transitioning from prison to communities; and $15,000,000 for the rehabilitation of existing property or buildings for housing offenders released from prison ARG Program

  5. Project Update The Budget Act of 2019 added $32,950,000 for Rental Assistance and Warm Hand-Off components and increased available funds: Warm Hand-Off/ Reentry: $25,001,250 Rental Assistance: $40,651,250 On July 11, 2019 a total of 69 awards were approved for these two components. About the BSCC… Reports directly to the Governor's Office Organized under a Governor appointed Board made up of 13 members Responsibilities include providing statewide leadership, coordination, and technical assistance to promote effective state and local efforts and partnerships in California’s adult and juvenile criminal justice system, including providing technical assistance and coordination to local governments related to public safety ARG PROGRAM

Applicant Eligibility Continued (pgs. 2-3) Applicants must use grant funds solely for the purpose of rehabbing property or buildings to house persons formerly incarcerated in state prison Projects supported by other funding sources, must ensure that the portion of property improved by BSCC funds is used solely to house individuals formerly incarcerated in state prison Projects supported by other funding sources should identify the funding sources at the time of application. Housing First The Adult Reentry Grant is subject to Welfare and Institutions Code § 8255-8257 Requires a state administering agency that provides housing or housing-related services to people experiencing homelessness or at risk of homelessness to adopt the core components of Housing First Authorizing legislation-Senate Bill 1380 Sept. 20 2016 (Handouts) ARG Program

  15. What Is Housing First ? Approach to service delivery and evidence-based model Uses housing as a tool, rather than a reward for recovery Provides or connects homeless people to permanent housing as quickly as possible Offers services as needed and requested on a voluntary basis Housing not contingent on participation in services or a lack of criminal history or abstinence Adult Reentry Grantees will be expected to implement a Housing First model to the extent that it applies to the specific services they offer ARG Program

  16. Target Population (pg. 3) People who have been formerly sentenced to and released from state prison Includes: People leaving state prison that are on parole Those monitored by the probation departments of each county through Post-Release Community Supervision (PRCS)(P). Does not include: DJJ 1170(h) ARG PROGRAM

  17. Eligible Projects (pg.3) Includes transitional housing, permanent housing and safe-haven housing Applicants must agree to house the target population until January 31, 2030 “Existing property” means real property owned by the applicant in fee simple at the time of application ARG Program

Eligible Projects (pg.3) “Rehabilitation” means: Repairs and improvements to housing required to house the target population May include rehabilitation standards as defined in Section 50097 of the Health and Safety Code Eliminate conditions specified in Section 17920.3 of the Health and Safety Code Repairs and improvements necessary to meet any locally standards for local rehabilitation programs Rehabilitation may include reconstruction ARG Program

  19. Eligible Projects (pg. 4) May use grant funds for: Administrative costs for CBO personnel (not to exceed 10%) 2. On-site costs of reconstruction + site preparation 3. Architectural programming and design 4. Reconstruction management 5. Building permit, sewer/utility use fees, & building inspection fees ARG Program

  20. Eligible Projects (pg. 4) May use grant funds for: 6. Soil/water contamination assessment mitigation 7. Fixed equipment items as necessary for operations 8. Fixed furnishings items as necessary for operations 9. Installation of existing fixed equipment and furnishings 10. Moveable equipment and furnishings 11. Preparation of property to meet environmental requirements ARG Program

  21. Eligible Projects (pg. 4) ARG Rehabilitation of Existing Property and Buildings Project grant funds may NOT be used for: 1. Acquisition of new property 2. Refinancing old debt 3. Operational funding 4. Delivery of services 5. Dislocation, displacement or relocation costs 6. Excavation of burial sites 7. Off-site costs 8. Office supplies and equipment 9. Bonus payments 10. Public art or décor items ARG Program

Funding (pg. 5) $15 million is available Applicants must apply for a minimum of $2 million Maximum $5 million 20% cash match required Must house persons formerly incarcerated in state prison for the duration of the grant period ending January 31, 2030 Operating budgets and occupancy reports upon completion of the construction project will be required annually ARG Program

Grant Requirements (pgs. 5-10) Funding is Awarded on a Conditional Basis Deed of Trust Execute and deliver a promissory note in the amount of the grant award Secure a deed of trust on property naming the BSCC as beneficiary Recorded junior only to such liens, encumbrances and other matters of record approved by the BSCC Must secure the BSCC’s financial interest in the project and the performance of the applicant’s program obligations The lien on the property or building constructed, renovated, or remodeled will remain until January 31, 2030 Foreclose upon the lien may occur if the nonprofit ceases to be a nonprofit organization or the facility is no longer used for the housing of persons released from state prison ARG PROGRAM

  25. Grant Requirements (pgs. 5-10) Funding is Awarded on a Conditional Basis Environmental Conditions Conditional Use Permit Submitted with in 90 days of conditional award CA. Environmental Quality Act (CEQA) Funded projects must have no significant effect on the environment and are statutorily or categorically exempt from the CEQA process Expected projects will be classified as Class 1, Class 2 or Class 3 categorical exemptions ARG PROGRAM

Grant Requirements (pgs.6-7) CEQA Continued… Appendix C Consult w/ Legal Counsel Provide sufficient information so that the BSCC may certify that the project is exempt BSCC will file a Notice of Exemption with the Governor’s Office of Planning and Research 35-Day statute of limitations period Notice of Exemption must be filed, statute of limitations expired, and all legal challenges have been resolved before BSCC will enter into a grant agreement Conditional award may be rescinded if any legal challenges remain unresolved after completion of the Notice of Exemption process ARG PROGRAM
