The criminal act of a child murder at childbirth exists when the mother deprives her child of life during the childbirth or directly after the childbirth while the disorder caused by birth is underway.
▐ the object of the attack can be exclusively a child born alive ▐ the perpetrator of the act can be only the mother of a child born alive ▐ the murder must be committed during the childbirth or directly after the birth while the mother suffers disorder caused by childbirth
If the act is committed by another person and the mother prompts him or helps him during the birth or directly after the birth while there is disturbance caused by birth in her going on, the mother is accomplice in the crime and the perpetrator commits heavy murder.

The attempt in this delict is possible and punishable regarding the threatening sanction. An the attempt must be undetook during the delivery or directly after the delivery while in mother lasts the disturbance the has been caused by delivery.
