  2. Employee Transfer Permit Service Definition :- It is a service provided to any establishment wishing to recruit an employee whose employment at other establishment has ended. Application Form :- New work permit Application Conditions – First : General Condition • Priority is filling vacancies shall be given to UAE and GCC nationals • The establishment shall have an approval for a quota of electronic work permits • The employee’s record at the ministry shall be free from any legal violations • The required employee’s passport shall be valid for no less than 6 months Continue…

Employee Transfer Permit • The employee shall not be below the age of 18 years • The profession assigned to the expatriate worker shall be commensurate with the establishment activities • The license of the establishment submitting the application shall be valid and free from any violations • The authorized signature shall not hold an e-signature card Condition – Second: Conditions on the end of the two year work relation between the employee and his previous employer • The work relation between the employee and the employer shall be ended by mutual agreement (cancelling the labour permit/card) • The period of employment shall not be less than two years

Employee Transfer Permit The following cases shall be excluded : • The employee required to be recruited will work for an establishment which the previous employer owns or has a share in • The profession assigned to the employee required to be recruited are among the three skill level as follows : • The total salary of the employee required to be recruited is not less than what is shown in the table below - The establishment shall abide by paying the employee’s monthly salary, as mentioned in the schedule above, through wage protection system Continue …

Employee Transfer Permit • The Ministry may grant the employee a permit for transferring to another establishment and approve cancellation of the work permit / card without satisfying the condition related to the employer’s approval or the lapse of two years at work, in the following cases : • The employer beaches his legal or contractual obligations • The employee is not responsible for ending the work relation such as : • A complaint is filed by the employee against his establishment because he was dismissed there form after its closure • A labour complain is referred from the MOL to the court. In such case, a final judgment must be issued in favor of the employee 4. The Ministry may drop the two year condition and grant a transfer permit if it makes sure that the employer dismissed the employee or did not renew his work permit without submitting his resignation

Employee Transfer Permit N.B : The work permit shall be valid for a period of 60days, which may be extended six times provided the following : • The approval fees and bank guarantee are paid during the 60 day validity period • AED 500 are paid for every 10 days to be calculated from the date of original expiry or the extended expiry date If such fees and bank guarantee are not paid within 60 days, the permit will be automatically cancelled Required Documents : • A color photograph with a white background of the employee • A copy of worker’s passport • If academic qualification is required, a copy thereof which should be authenticated by the Ministry of foreign Affairs shall be attached Continue…

  7. Employee Transfer Permit Required Documents : • A letter of approval issues by the competent entity shall be attached, if so required (physician, pharmacist, nurse, teacher) Service Execution Steps : • The application form is printed and sent electronically to the Ministry • Fulfilling the conditions is checked and verified • The Ministry shall issue its approval or state unfulfilled conditions and send the same to the website (www.mol.gov.ae) • The notice of approval is printed, the due fees and bank guarantee are paid, and the application is completed and sent back if there is any missing data • The customer shall go to the General Directorate of Residency and Foreigners Affairs, show the notice “Referring the transaction to the General Directorate of Residency and Foreigners Affairs” and complete the procedures necessary for obtaining a labour entry visa.
