  1. P&I Clubs & Hull Insurers: What role for the P&I Club in MARVIN? Emily M. Weitzenböck Norwegian Research Centre for Computers & Law University of Oslo Lisbon, 11-14th October 1999

  2. Hull Insurance Cover • A Hull Insurance covers: • (a) the ship, • (b) equipment on board and spare parts for the ship and its equipment, provided that the equipment or spare parts belong to the assured or have been borrowed, hired or purchased with subject to a seller's lien or similar reservation, • (c) bunkers and lubrication oil on board. (Norwegian Marine Insurance Plan (§10-1)

  3. Hull Insurance (cont.) • A hull insurance does not cover: • (a) supplies, engine and deck accessories and other articles intended for consumption, • (b) boats and equipment used for fishing, whaling, sealing and similar activities, • (c) loose objects exclusively intended for securing or protecting the cargo, • (d) loose containers intended for the carriage of cargo. (Norwegian Marine Insurance Plan (§10-1) • It does not appear that a P&I club has a role in the scenario specified in Doc.Ref. 1-00-W-1999-01-3 drawn up by GL and LMS.

  4. P&I insurance cover • The cover provided by a P&I insurance is wide and has been described as follows: • "To say that the clubs cover everything not covered by some other policy of insurance would not be too wide of the mark, and to say that the clubs were a receptacle for all risks unplaceable elsewhere sounds disparaging, but nevertheless reasonably describes the position. A true enough description of a P & I club insurer is that he covers shipowners (or whomever) against their legal liabilities to third parties” (Hill, Robertson and Hazelwood, Practical Guides: Introduction to P&I)

  5. Some of the risks insured against under P&I club cover: • Liabilities in respect of the crew • Liabilities in respect of passengers • Liabilities for other persons carried on board • Diversion expenses • Fines • Pollution • Collisions • Life salvage • Stowaways, refugees or persons saved at sea

  6. Some of the risks insured against under P&I club cover (cont.): • Quarantine expenses • Damage to fixed objects and floating objects • Cargo • Extra handling costs • Irrecoverable general average • Ship's proportion of general average • Towage contracts • Wreck • Legal costs • Enquiry expenses

  7. To consider & decide re the P&I Club: • Amend Scenario Specification for all actors? • Amend Scenario Specification only for the P&I club (to enable P&I club to be included as an actor)? • Keep Scenario Specification as it is and exclude P&I club as an actor?
