Why do we have ADCOs? • Market surveillance responsibility belongs to Member states • Allows m/states to tailor their practices to suit their own circumstances but …… • difficult to do in isolation • need to share best practice and data • need to exchange information on specific cases • need to have informal practices to back up the formal ones (PED Arts 6-8) • Industry operates across borders – so should we! • Successful precedent already with 10 New Approach directives • Council Resolution of 10 Nov. 2003 & PED Art.17

  4. Council Resolution of 10 Nov. 2003 (2003/C 282/02) • ‘The Council of the EU welcomes the Commission’s Communication on ‘Enhancing the Implementation of the New Approach Directives’ and ….. Invites the Commission to propose appropriate initiatives in the field of …. market surveillance … to consider with Member States essential requirements defining the objectives to be achieved by the Member States with regard to market surveillance and to introduce in New Approach legislation a framework for the relevant administrative co-operation including the exchange of information among Member States ((b)1)

  5. What can ADCOs hope to achieve? • Secure, named, relevant contacts in each Member State • Co-operation on specific cases • Sharing of product testing results • Informal safeguard procedure • Joint market surveillance exercises

  6. Key Features of WGA – the PED ADCO • Inaugural meeting in March 2004 • Objectives and rules of procedure in PE ADCO 04/01 (on circa) • Chaired by volunteer member state • Two meetings per annum in Brussels with interpretation • March meeting discussed Chinese pressure cookers and breathing apparatus with several bottles • Open to national authorities, the Commission and others by invitation – come and join in!
