  2. Disadvantaged Business Enterprise Program(DBE)

  3. DBE Program • Purpose of the DBE Program • DBE Qualifications • Proposal Requirements • Good Faith Efforts (GFE)

  4. DBE Program Purpose • Ensures non-discrimination in the award and administration of federally-assisted contracts • Assists in the development of firms by leveling the playfield so that small minority firms may compete within the marketplace

  5. DBE Program Qualifications • Individual must own and control at least 51% of the business • Net worth must not exceed $750,000 • Business can not exceed SBA size standards • Majority owners must be US Citizens and part of a protected class (i.e. Hispanic, woman, Native American, etc.) • Past 3 years average annual sales can not exceed $22.41 million

Bid Requirements (DBE) • Form D - Schedule of Disadvantaged Business Enterprise Participation • must be completed and signed • Include all firms participating on the project (DBE & Non-DBE firms) • DBE firms must be certified by proposal due date to count toward DBE contract goal North Carolina UCP Database https://apps.dot.state.nc.us/vendor/directory

Good Faith Efforts • Good Faith Efforts (GFE) • Should be submitted as part of the proposal package if total DBE Participation on Form D is less than specified DBE goals outlined in each RFP document • If DBE participation is verified to be less than the DBE goal and no GFE’s are submitted, proposer will be found to be unresponsive

  9. DBE Good Faith Efforts Examples • Soliciting interest from certified DBE’s • Actions at pre-proposal meeting • Advertising • Written request for quotes • Breaking up work into economically feasible units to facilitate DBE participation • Providing plans to interested DBE’s • Making efforts to assist DBE’s in obtaining necessary equipment, supplies, materials, or related services

  10. Additional Good Faith Efforts • Using minority, community groups, or contractor associations to aid in recruitment • Document evidence of GFE and negotiations. Include names, addresses, telephone numbers of DBE’s that were considered and evidence as to why agreements could not be reached
