  3. The US Constitution :all US laws are based upon. The Constitution is the reason that we have the right to privacy, the right to a trial with a jury of our peers, and many other freedoms. • Created September 17, 1787 • The Constitution has been amended twenty-seven times; the first ten amendments are known as the Bill of Rights.

Bill of Rights • All about individuals rights: freedom of speech, religion, bear arms, fair trials etc. Gives power to individual states to create laws. • How does this affect health care? • Tons of laws in healthcare: • Employee Retirement Income Security Act of 1974 (ERISA) • Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA), • The Health Insurance Portability and Accountability Act (HIPAA), • Newborns' and Mothers' Health Protection Act (Newborns' Act) • Mental Health Parity Act (MHPA) • Women's Health and Cancer Rights Act (WHCRA) • Laws how care is given, licensing for practitioners etc.

  8. Other Sources of Health Policy • Health policy in the United States involves federal, state, and local governmental agencies. OSHA, HIPAA– Fed, but states carry out.. Licenses, inspections • it requires enormous expenditures and is funded by various sources.

Multiple “Layers” • Government agencies in charge of public health policy coordinate their efforts with thoseof private health care organizations to achieve public health care goals. • Surveillance and data collection for diseases • All states have state health departments • State laws focus on preserving public health; federal laws focus on federal health • Local Agencies

  10. The Role of Local Agencies • Engaging in surveillance and monitoring of diseases • Administering immunizations • Screening for communicable diseases • Offering patient education • Coordinating the provision of private and public health services
